Mais cette \u00e9volution soul\u00e8ve une question essentielle : <strong data-start=\"517\" data-end=\"576\">quelles sont les limites juridiques \u00e0 ne pas franchir ?<\/strong> Car en mati\u00e8re de surveillance, de recrutement ou de productivit\u00e9, le droit encadre strictement les usages de l\u2019IA.<\/p>\n<h2 data-start=\"694\" data-end=\"774\">L\u2019usage de l\u2019IA en entreprise : un cadre juridique encore flou, mais existant<\/h2>\n<p data-start=\"776\" data-end=\"1112\">En 2025, aucune l\u00e9gislation sp\u00e9cifique n\u2019encadre globalement l\u2019intelligence artificielle en entreprise. Toutefois, cela ne signifie pas un vide juridique. Les principes existants en mati\u00e8re de <strong data-start=\"969\" data-end=\"1068\">protection des donn\u00e9es personnelles, libert\u00e9s individuelles, non-discrimination et transparence<\/strong> s\u2019appliquent pleinement aux usages de l\u2019IA.<\/p>\n<p data-start=\"1114\" data-end=\"1297\">\ud83d\udd0d Le <b>R\u00e8glement g\u00e9n\u00e9ral sur la protection des donn\u00e9es<\/b> (RGPD), la loi Informatique et Libert\u00e9s et le Code du travail forment d\u00e9j\u00e0 un socle solide pour encadrer les pratiques employeur.<\/p>\n<h2 data-start=\"1299\" data-end=\"1372\">L\u2019IA dans le recrutement : attention \u00e0 la discrimination algorithmique<\/h2>\n<p data-start=\"1374\" data-end=\"1648\">De plus en plus d\u2019employeurs utilisent des logiciels pour trier les CV, analyser les entretiens vid\u00e9o ou pr\u00e9dire la compatibilit\u00e9 d\u2019un profil. Ces outils peuvent g\u00e9n\u00e9rer des biais discriminatoires, parfois involontaires, li\u00e9s aux donn\u00e9es d\u2019entra\u00eenement ou \u00e0 leur conception.<\/p>\n<p data-start=\"1650\" data-end=\"1850\">\u27a1\ufe0f <strong data-start=\"1653\" data-end=\"1673\">Rappel juridique<\/strong> : toute forme de discrimination \u00e0 l\u2019embauche (\u00e2ge, sexe, origine, handicap, orientation\u2026) est strictement interdite, m\u00eame si elle est le r\u00e9sultat d\u2019un traitement algorithmique.<\/p>\n<p data-start=\"1852\" data-end=\"2007\">L\u2019employeur reste <strong data-start=\"1870\" data-end=\"1908\">responsable du choix de ses outils<\/strong> et doit pouvoir d\u00e9montrer que leur fonctionnement est <strong data-start=\"1963\" data-end=\"2006\">transparent, non biais\u00e9 et non exclusif<\/strong>.<\/p>\n<h2 data-start=\"2009\" data-end=\"2070\">IA et surveillance des salari\u00e9s : jusqu\u2019o\u00f9 peut-on aller ?<\/h2>\n<p data-start=\"2072\" data-end=\"2291\">Certains outils permettent de mesurer la productivit\u00e9, de suivre le temps pass\u00e9 sur chaque t\u00e2che ou de d\u00e9tecter les comportements \u00ab d\u00e9viants \u00bb. Ces dispositifs peuvent rapidement empi\u00e9ter sur les libert\u00e9s individuelles.<\/p>\n<p data-start=\"2293\" data-end=\"2369\">Le Code du travail et la jurisprudence encadrent strictement ces pratiques :<\/p>\n<ul data-start=\"2371\" data-end=\"2711\">\n<li data-start=\"2371\" data-end=\"2444\">\n<p data-start=\"2373\" data-end=\"2444\">Toute surveillance doit \u00eatre <strong data-start=\"2402\" data-end=\"2442\">proportionn\u00e9e \u00e0 l\u2019objectif poursuivi<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"2445\" data-end=\"2535\">\n<p data-start=\"2447\" data-end=\"2535\">Les salari\u00e9s doivent \u00eatre <strong data-start=\"2473\" data-end=\"2503\">inform\u00e9s de mani\u00e8re claire<\/strong> sur la finalit\u00e9 du traitement ;<\/p>\n<\/li>\n<li data-start=\"2536\" data-end=\"2611\">\n<p data-start=\"2538\" data-end=\"2611\">Le <strong data-start=\"2541\" data-end=\"2576\">CSE doit \u00eatre consult\u00e9 en amont<\/strong> pour tout dispositif de contr\u00f4le ;<\/p>\n<\/li>\n<li data-start=\"2612\" data-end=\"2711\">\n<p data-start=\"2614\" data-end=\"2711\">L\u2019usage de donn\u00e9es sensibles ou l\u2019analyse \u00e9motionnelle est <strong data-start=\"2673\" data-end=\"2710\">hautement encadr\u00e9, voire interdit<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2713\" data-end=\"2851\">Un manquement \u00e0 ces r\u00e8gles peut entra\u00eener des sanctions de la CNIL, des contentieux prud\u2019homaux et un pr\u00e9judice d\u2019image pour l\u2019entreprise.<\/p>\n<h2 data-start=\"2853\" data-end=\"2917\">L\u2019IA ne peut pas remplacer l\u2019humain dans la prise de d\u00e9cision<\/h2>\n<p data-start=\"2919\" data-end=\"3112\">Le recours \u00e0 l\u2019intelligence artificielle ne doit pas conduire \u00e0 <strong data-start=\"2983\" data-end=\"3058\">automatiser les d\u00e9cisions affectant directement les droits d\u2019un salari\u00e9<\/strong>, comme un licenciement, une mutation ou une sanction.<\/p>\n<p data-start=\"3114\" data-end=\"3455\">L\u2019article 22 du RGPD interdit la prise de d\u00e9cision automatis\u00e9e sans intervention humaine significative, sauf exceptions tr\u00e8s encadr\u00e9es. En pratique, cela signifie que <strong data-start=\"3281\" data-end=\"3343\">l\u2019employeur doit toujours exercer un jugement humain final<\/strong>, en s\u2019appuyant \u00e9ventuellement sur les recommandations de l\u2019IA, mais jamais en se reposant exclusivement dessus.<\/p>\n<h2 data-start=\"3457\" data-end=\"3523\">Vers un futur encadr\u00e9 : l\u2019impact du r\u00e8glement europ\u00e9en sur l\u2019IA<\/h2>\n<p data-start=\"3525\" data-end=\"3859\">Le futur r\u00e8glement europ\u00e9en sur l\u2019intelligence artificielle (AI Act), en cours de finalisation, pr\u00e9voit un encadrement renforc\u00e9 des syst\u00e8mes d\u2019IA dits \u00ab \u00e0 haut risque \u00bb, notamment dans les relations de travail. Les outils utilis\u00e9s pour le recrutement, la gestion du personnel ou l\u2019\u00e9valuation des performances pourraient y \u00eatre soumis.<\/p>\n<p data-start=\"3861\" data-end=\"3896\">Les entreprises devront notamment :<\/p>\n<ul data-start=\"3898\" data-end=\"4149\">\n<li data-start=\"3898\" data-end=\"3981\">\n<p data-start=\"3900\" data-end=\"3981\"><strong data-start=\"3900\" data-end=\"3979\">Assurer une tra\u00e7abilit\u00e9 et une documentation compl\u00e8te des syst\u00e8mes utilis\u00e9s<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"3982\" data-end=\"4056\">\n<p data-start=\"3984\" data-end=\"4056\"><strong data-start=\"3984\" data-end=\"4054\">Mettre en place des mesures de transparence vis-\u00e0-vis des salari\u00e9s<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"4057\" data-end=\"4149\">\n<p data-start=\"4059\" data-end=\"4149\"><strong data-start=\"4059\" data-end=\"4117\">Garantir un droit \u00e0 l\u2019explication et \u00e0 la contestation<\/strong> en cas de d\u00e9cision automatis\u00e9e.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4151\" data-end=\"4271\">Anticiper cette r\u00e9glementation est une n\u00e9cessit\u00e9 pour les employeurs souhaitant int\u00e9grer l\u2019IA durablement et l\u00e9galement.<\/p>\n<h2 data-start=\"4273\" data-end=\"4335\">L&#8217;IA, une innovation \u00e0 encadrer, pas \u00e0 improviser<\/h2>\n<p data-start=\"4337\" data-end=\"4601\">L\u2019intelligence artificielle offre des opportunit\u00e9s r\u00e9elles d\u2019optimisation, mais elle <strong data-start=\"4422\" data-end=\"4499\">ne doit jamais se faire au d\u00e9triment des droits fondamentaux des salari\u00e9s<\/strong>.
