En 2025, les r\u00e8gles demeurent exigeantes et les employeurs doivent faire preuve de rigueur pour se conformer \u00e0 leurs obligations sociales. Quels sont les seuils \u00e0 respecter ? Quels d\u00e9lais appliquer ? Et que risque une entreprise en cas de manquement ? Faisons le point.<\/p>\n<h2 data-start=\"560\" data-end=\"630\">Le seuil d\u2019effectif : \u00e0 partir de quand le CSE est-il obligatoire ?<\/h2>\n<p data-start=\"632\" data-end=\"838\">Le CSE est obligatoire dans <strong data-start=\"660\" data-end=\"703\">toute entreprise d\u2019au moins 11 salari\u00e9s<\/strong> pendant <strong data-start=\"712\" data-end=\"735\">12 mois cons\u00e9cutifs<\/strong>. Ce seuil s\u2019appr\u00e9cie en \u00e9quivalent temps plein (ETP), sur la base d\u2019un d\u00e9compte mensuel de l\u2019effectif.<\/p>\n<p data-start=\"840\" data-end=\"1068\">Il ne suffit donc pas d\u2019atteindre ponctuellement 11 salari\u00e9s : l\u2019employeur doit observer une <strong data-start=\"933\" data-end=\"968\">moyenne sur 12 mois cons\u00e9cutifs<\/strong>. Ce contr\u00f4le est automatique et s\u2019applique d\u00e8s lors que l\u2019entreprise franchit durablement ce seuil.<\/p>\n<p data-start=\"1070\" data-end=\"1235\">\ud83d\udd0d <strong data-start=\"1073\" data-end=\"1083\">Rappel<\/strong> : si l\u2019entreprise atteint 50 salari\u00e9s pendant 12 mois, le CSE dispose alors de pr\u00e9rogatives \u00e9largies (consultations \u00e9conomiques, droit d\u2019alerte, etc.).<\/p>\n<h2 data-start=\"1237\" data-end=\"1292\">Quels sont les d\u00e9lais pour organiser les \u00e9lections ?<\/h2>\n<p data-start=\"1294\" data-end=\"1441\">L\u2019employeur doit engager la proc\u00e9dure d\u2019\u00e9lection du CSE <strong data-start=\"1350\" data-end=\"1424\">au plus tard \u00e0 l\u2019issue des 12 mois cons\u00e9cutifs de d\u00e9passement du seuil<\/strong>. Cela signifie :<\/p>\n<ul data-start=\"1443\" data-end=\"1749\">\n<li data-start=\"1443\" data-end=\"1517\">\n<p data-start=\"1445\" data-end=\"1517\">Une obligation d\u2019informer les salari\u00e9s de l\u2019organisation des \u00e9lections ;<\/p>\n<\/li>\n<li data-start=\"1518\" data-end=\"1575\">\n<p data-start=\"1520\" data-end=\"1575\">Le lancement du processus \u00e9lectoral dans les 90 jours ;<\/p>\n<\/li>\n<li data-start=\"1576\" data-end=\"1660\">\n<p data-start=\"1578\" data-end=\"1660\">La conclusion \u00e9ventuelle d\u2019un protocole d\u2019accord pr\u00e9\u00e9lectoral avec les syndicats ;<\/p>\n<\/li>\n<li data-start=\"1661\" data-end=\"1749\">\n<p data-start=\"1663\" data-end=\"1749\">L\u2019organisation du premier tour du scrutin sous 15 jours apr\u00e8s validation du protocole.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1751\" data-end=\"1866\">\u23f3 <strong data-start=\"1753\" data-end=\"1764\">\u00c0 noter<\/strong> : un renouvellement du CSE doit \u00e9galement respecter des d\u00e9lais sp\u00e9cifiques pour \u00e9viter toute carence.<\/p>\n<h2 data-start=\"1868\" data-end=\"1921\">Quelles sont les obligations \u00e0 respecter en 2025 ?<\/h2>\n<p data-start=\"1923\" data-end=\"2047\">En 2025, les obligations li\u00e9es au CSE restent inchang\u00e9es sur le fond, mais leur mise en \u0153uvre appelle une vigilance accrue :<\/p>\n<ul data-start=\"2049\" data-end=\"2436\">\n<li data-start=\"2049\" data-end=\"2122\">\n<p data-start=\"2051\" data-end=\"2122\"><strong data-start=\"2051\" data-end=\"2090\">D\u00e9compter pr\u00e9cis\u00e9ment les effectifs<\/strong> et archiver les justificatifs ;<\/p>\n<\/li>\n<li data-start=\"2123\" data-end=\"2188\">\n<p data-start=\"2125\" data-end=\"2188\"><strong data-start=\"2125\" data-end=\"2186\">Mettre en place un calendrier \u00e9lectoral clair et tra\u00e7able<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"2189\" data-end=\"2317\">\n<p data-start=\"2191\" data-end=\"2317\"><strong data-start=\"2191\" data-end=\"2250\">Respecter le principe de loyaut\u00e9 du processus \u00e9lectoral<\/strong>, notamment en mati\u00e8re d\u2019information des syndicats repr\u00e9sentatifs ;<\/p>\n<\/li>\n<li data-start=\"2318\" data-end=\"2436\">\n<p data-start=\"2320\" data-end=\"2436\"><strong data-start=\"2320\" data-end=\"2363\">Tenir \u00e0 jour les registres obligatoires<\/strong>, notamment le proc\u00e8s-verbal de carence en cas d\u2019absence de candidatures.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2438\" data-end=\"2739\">Dans les entreprises de 11 \u00e0 49 salari\u00e9s, le CSE exerce principalement des missions d\u2019expression collective et de pr\u00e9sentation des r\u00e9clamations. Au-del\u00e0 de 50 salari\u00e9s, il devient <strong data-start=\"2618\" data-end=\"2654\">un acteur cl\u00e9 du dialogue social<\/strong>, avec des droits d\u2019information et de consultation sur les d\u00e9cisions de l\u2019entreprise.<\/p>\n<h2 data-start=\"2741\" data-end=\"2790\">Quels sont les risques en cas de non-respect ?<\/h2>\n<p data-start=\"2792\" data-end=\"2895\">Le non-respect des obligations li\u00e9es \u00e0 la mise en place du CSE expose l\u2019employeur \u00e0 plusieurs risques :<\/p>\n<ul data-start=\"2897\" data-end=\"3224\">\n<li data-start=\"2897\" data-end=\"3028\">\n<p data-start=\"2899\" data-end=\"3028\"><strong data-start=\"2899\" data-end=\"2932\">Sanction pour d\u00e9lit d\u2019entrave<\/strong> (amende de 7 500 \u20ac pour les personnes physiques, jusqu\u2019\u00e0 37 500 \u20ac pour les personnes morales) ;<\/p>\n<\/li>\n<li data-start=\"3029\" data-end=\"3099\">\n<p data-start=\"3031\" data-end=\"3099\"><strong data-start=\"3031\" data-end=\"3097\">Nullit\u00e9 de certaines d\u00e9cisions prises sans consultation du CSE<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"3100\" data-end=\"3224\">\n<p data-start=\"3102\" data-end=\"3224\"><strong data-start=\"3102\" data-end=\"3223\">Possibilit\u00e9 pour un salari\u00e9 ou un syndicat de saisir le tribunal judiciaire pour imposer l\u2019organisation des \u00e9lections<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3226\" data-end=\"3406\">Par ailleurs, <strong data-start=\"3240\" data-end=\"3327\">l\u2019absence de CSE peut fragiliser consid\u00e9rablement l\u2019employeur en cas de contentieux<\/strong>, notamment en mati\u00e8re de licenciement \u00e9conomique ou de r\u00e9organisation interne.<\/p>\n<h2 data-start=\"3408\" data-end=\"3477\">Anticiper et s\u00e9curiser : le r\u00f4le cl\u00e9 de l\u2019accompagnement juridique<\/h2>\n<p data-start=\"3479\" data-end=\"3724\">La mise en place du CSE n\u2019est pas une simple formalit\u00e9. Elle implique une <strong data-start=\"3553\" data-end=\"3646\">ma\u00eetrise des d\u00e9lais, du formalisme \u00e9lectoral et des r\u00e8gles de repr\u00e9sentation du personnel<\/strong>.
