Mais il a aussi fait \u00e9merger de nouvelles probl\u00e9matiques juridiques, notamment autour des accidents pouvant survenir au domicile du salari\u00e9. L\u2019entreprise reste-t-elle responsable en cas d\u2019accident pendant le t\u00e9l\u00e9travail ? Comment s\u2019en pr\u00e9munir ?<\/p>\n<h2 data-start=\"603\" data-end=\"667\">L\u2019accident du travail en t\u00e9l\u00e9travail : une pr\u00e9somption l\u00e9gale<\/h2>\n<p data-start=\"669\" data-end=\"992\">Selon l\u2019article L1222-9 du Code du travail, tout accident survenu au salari\u00e9 en t\u00e9l\u00e9travail pendant la p\u00e9riode d\u2019ex\u00e9cution de son activit\u00e9 professionnelle est pr\u00e9sum\u00e9 \u00eatre un accident du travail. Cette <strong data-start=\"871\" data-end=\"898\">pr\u00e9somption automatique<\/strong> vise \u00e0 assurer une protection \u00e9quivalente \u00e0 celle dont b\u00e9n\u00e9ficie un salari\u00e9 pr\u00e9sent sur site.<\/p>\n<p data-start=\"994\" data-end=\"1213\">Autrement dit, un salari\u00e9 qui chute, se blesse ou fait un malaise chez lui <strong data-start=\"1069\" data-end=\"1104\">pendant ses horaires de travail<\/strong> est r\u00e9put\u00e9 avoir subi un accident du travail, <strong data-start=\"1151\" data-end=\"1212\">sauf preuve contraire apport\u00e9e par l\u2019employeur ou la CPAM<\/strong>.<\/p>\n<h2 data-start=\"1215\" data-end=\"1276\">L\u2019entreprise reste garante de la s\u00e9curit\u00e9, m\u00eame \u00e0 distance<\/h2>\n<p data-start=\"1278\" data-end=\"1435\">Loin de d\u00e9gager l\u2019employeur de sa responsabilit\u00e9, le t\u00e9l\u00e9travail <strong data-start=\"1343\" data-end=\"1434\">renforce l\u2019exigence de pr\u00e9vention et d\u2019encadrement des conditions de travail \u00e0 domicile<\/strong>.<\/p>\n<p data-start=\"1437\" data-end=\"1552\">M\u00eame \u00e0 distance, l\u2019employeur est tenu par son obligation de s\u00e9curit\u00e9 (article L4121-1 du Code du travail) et doit :<\/p>\n<ul data-start=\"1554\" data-end=\"1850\">\n<li data-start=\"1554\" data-end=\"1671\">\n<p data-start=\"1556\" data-end=\"1671\">Informer les salari\u00e9s sur les risques li\u00e9s au travail isol\u00e9, aux troubles musculo-squelettiques, \u00e0 la s\u00e9dentarit\u00e9 ;<\/p>\n<\/li>\n<li data-start=\"1672\" data-end=\"1769\">\n<p data-start=\"1674\" data-end=\"1769\">S\u2019assurer, autant que possible, que le poste de travail est adapt\u00e9 (mobilier, \u00e9cran, lumi\u00e8re) ;<\/p>\n<\/li>\n<li data-start=\"1770\" data-end=\"1850\">\n<p data-start=\"1772\" data-end=\"1850\">D\u00e9finir clairement les plages horaires et les r\u00e8gles de connexion\/d\u00e9connexion.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1852\" data-end=\"2019\">En cas d\u2019accident reconnu, <strong data-start=\"1879\" data-end=\"1923\">un d\u00e9faut de pr\u00e9vention ou d\u2019encadrement<\/strong> peut conduire \u00e0 une faute inexcusable de l\u2019employeur, avec de lourdes cons\u00e9quences financi\u00e8res.<\/p>\n<h2 data-start=\"2021\" data-end=\"2063\">Quels types d\u2019accidents sont reconnus ?<\/h2>\n<p data-start=\"2065\" data-end=\"2193\">Les tribunaux retiennent de plus en plus largement la qualification d\u2019accident du travail, d\u00e8s lors que l\u2019incident est survenu :<\/p>\n<ul data-start=\"2195\" data-end=\"2399\">\n<li data-start=\"2195\" data-end=\"2240\">\n<p data-start=\"2197\" data-end=\"2240\">Pendant les horaires habituels de travail ;<\/p>\n<\/li>\n<li data-start=\"2241\" data-end=\"2316\">\n<p data-start=\"2243\" data-end=\"2316\">Sur le lieu d\u00e9clar\u00e9 comme poste de t\u00e9l\u00e9travail (domicile ou tiers-lieu) ;<\/p>\n<\/li>\n<li data-start=\"2317\" data-end=\"2399\">\n<p data-start=\"2319\" data-end=\"2399\">Lors d\u2019une activit\u00e9 professionnelle (appel client, traitement de dossier, etc.).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2401\" data-end=\"2601\">Mais attention : un accident survenu <strong data-start=\"2438\" data-end=\"2498\">en dehors du temps de travail ou dans un cadre personnel<\/strong> ne b\u00e9n\u00e9ficie pas de cette pr\u00e9somption. D\u2019o\u00f9 l\u2019importance de tracer les horaires et les temps de pause.<\/p>\n<h2 data-start=\"2603\" data-end=\"2658\">Comment s\u00e9curiser l\u2019employeur ? Les bonnes pratiques<\/h2>\n<p data-start=\"2660\" data-end=\"2738\">Pour r\u00e9duire les risques, il est essentiel d\u2019adopter une approche structur\u00e9e :<\/p>\n<ul data-start=\"2740\" data-end=\"3197\">\n<li data-start=\"2740\" data-end=\"2886\">\n<p data-start=\"2742\" data-end=\"2886\"><strong data-start=\"2742\" data-end=\"2795\">Formaliser un accord ou une charte de t\u00e9l\u00e9travail<\/strong>, pr\u00e9cisant les conditions d\u2019exercice, les plages horaires, les responsabilit\u00e9s partag\u00e9es ;<\/p>\n<\/li>\n<li data-start=\"2887\" data-end=\"2988\">\n<p data-start=\"2889\" data-end=\"2988\"><strong data-start=\"2889\" data-end=\"2912\">Former les salari\u00e9s<\/strong> sur les bonnes pratiques en mati\u00e8re d\u2019ergonomie et de gestion des risques ;<\/p>\n<\/li>\n<li data-start=\"2989\" data-end=\"3088\">\n<p data-start=\"2991\" data-end=\"3088\"><strong data-start=\"2991\" data-end=\"3031\">Documenter les conditions de travail<\/strong> : questionnaires, visites \u00e0 distance, guides pratiques ;<\/p>\n<\/li>\n<li data-start=\"3089\" data-end=\"3197\">\n<p data-start=\"3091\" data-end=\"3197\"><strong data-start=\"3091\" data-end=\"3141\">Conserver une preuve de l\u2019am\u00e9nagement du poste<\/strong> de travail (photos, attestations, \u00e9quipements fournis).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3199\" data-end=\"3311\">Ces \u00e9l\u00e9ments constituent autant de pi\u00e8ces \u00e0 produire en cas de litige avec la CPAM ou de contentieux prud\u2019homal.<\/p>\n<h2 data-start=\"3313\" data-end=\"3378\">Le r\u00f4le cl\u00e9 de la pr\u00e9vention dans un mod\u00e8le de travail hybride<\/h2>\n<p data-start=\"3380\" data-end=\"3569\">Le t\u00e9l\u00e9travail s\u2019installe durablement dans les organisations.
