Mais cette facult\u00e9 n\u2019est pas sans limites. Quels sont les droits de l\u2019employeur ? Et jusqu\u2019o\u00f9 peut-il aller sans risquer de commettre un abus ?\u00a0<\/p>\n<h2 data-start=\"513\" data-end=\"556\"><b>Qu\u2019est-ce qu\u2019une clause de mobilit\u00e9 ?<\/b><\/h2>\n<p data-start=\"558\" data-end=\"794\">Une clause de mobilit\u00e9 est une disposition \u00e9crite du contrat de travail qui pr\u00e9voit que le salari\u00e9 pourra \u00eatre mut\u00e9 dans une autre zone g\u00e9ographique d\u00e9finie \u00e0 l\u2019avance, <strong data-start=\"727\" data-end=\"793\">sans que cela constitue une modification du contrat de travail<\/strong>.<\/p>\n<p data-start=\"796\" data-end=\"972\">Elle permet donc \u00e0 l\u2019employeur de changer le lieu de travail, <strong data-start=\"858\" data-end=\"899\">dans les limites fix\u00e9es par la clause<\/strong>, sans devoir recueillir \u00e0 nouveau l\u2019accord du salari\u00e9 \u00e0 chaque mutation.<\/p>\n<p data-start=\"974\" data-end=\"1173\"><b>Attention<\/b> : en l\u2019absence de clause de mobilit\u00e9, tout changement de lieu de travail hors du secteur g\u00e9ographique habituel constitue une <strong data-start=\"1112\" data-end=\"1139\">modification du contrat<\/strong>, n\u00e9cessitant l\u2019accord du salari\u00e9.<\/p>\n<h2 data-start=\"1175\" data-end=\"1240\"><b>Quelles conditions de validit\u00e9 pour la clause de mobilit\u00e9 ?<\/b><\/h2>\n<p data-start=\"1242\" data-end=\"1330\">Pour \u00eatre valide, la clause de mobilit\u00e9 doit respecter certains principes fondamentaux :<\/p>\n<ul data-start=\"1332\" data-end=\"1684\">\n<li data-start=\"1332\" data-end=\"1398\">\n<p data-start=\"1334\" data-end=\"1398\"><strong data-start=\"1334\" data-end=\"1396\">\u00catre pr\u00e9vue dans le contrat de travail ou un avenant sign\u00e9<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"1399\" data-end=\"1558\">\n<p data-start=\"1401\" data-end=\"1558\"><strong data-start=\"1401\" data-end=\"1459\">D\u00e9finir pr\u00e9cis\u00e9ment la zone g\u00e9ographique d\u2019application<\/strong> (par exemple, \u201ctoute la r\u00e9gion Nouvelle-Aquitaine\u201d ou \u201ctout le territoire national\u201d si justifi\u00e9) ;<\/p>\n<\/li>\n<li data-start=\"1559\" data-end=\"1684\">\n<p data-start=\"1561\" data-end=\"1684\"><strong data-start=\"1561\" data-end=\"1630\">Ne pas porter une atteinte disproportionn\u00e9e aux droits du salari\u00e9<\/strong> (vie personnelle, temps de transport, famille, etc.).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1686\" data-end=\"1836\">Une clause floue ou \u00e0 g\u00e9om\u00e9trie variable (ex. \u201cdans toute zone d\u00e9termin\u00e9e par l\u2019entreprise\u201d) pourra \u00eatre consid\u00e9r\u00e9e comme abusive et donc inopposable.<\/p>\n<h2 data-start=\"1838\" data-end=\"1893\"><b>Quels sont les droits et limites de l\u2019employeur ?<\/b><\/h2>\n<p data-start=\"1895\" data-end=\"1995\">L\u2019employeur ne peut pas activer la clause de mobilit\u00e9 de mani\u00e8re arbitraire. Sa mise en \u0153uvre doit :<\/p>\n<ul data-start=\"1997\" data-end=\"2223\">\n<li data-start=\"1997\" data-end=\"2104\">\n<p data-start=\"1999\" data-end=\"2104\"><strong data-start=\"1999\" data-end=\"2047\">Respecter un d\u00e9lai de pr\u00e9venance raisonnable<\/strong>, tenant compte des contraintes personnelles du salari\u00e9 ;<\/p>\n<\/li>\n<li data-start=\"2105\" data-end=\"2157\">\n<p data-start=\"2107\" data-end=\"2157\"><strong data-start=\"2107\" data-end=\"2155\">\u00catre justifi\u00e9e par l\u2019int\u00e9r\u00eat de l\u2019entreprise<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"2158\" data-end=\"2223\">\n<p data-start=\"2160\" data-end=\"2223\"><strong data-start=\"2160\" data-end=\"2222\">Ne pas avoir pour objet ou effet de sanctionner un salari\u00e9<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2225\" data-end=\"2473\">La jurisprudence rappelle que <strong data-start=\"2255\" data-end=\"2334\">l\u2019application abusive ou brutale d\u2019une clause de mobilit\u00e9 peut \u00eatre annul\u00e9e<\/strong> et donner lieu \u00e0 des dommages et int\u00e9r\u00eats, voire \u00e0 une requalification du d\u00e9part du salari\u00e9 en licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<h2 data-start=\"2475\" data-end=\"2525\"><b>Le refus du salari\u00e9 : quelles cons\u00e9quences ?<\/b><\/h2>\n<p data-start=\"2527\" data-end=\"2766\">Si la clause est valide et que la mutation entre bien dans la zone pr\u00e9vue, <strong data-start=\"2602\" data-end=\"2651\">le refus du salari\u00e9 peut constituer une faute<\/strong>, voire un motif de licenciement. Toutefois, <strong data-start=\"2696\" data-end=\"2764\">chaque cas est \u00e0 appr\u00e9cier au regard des circonstances concr\u00e8tes<\/strong> :<\/p>\n<ul data-start=\"2768\" data-end=\"2934\">\n<li data-start=\"2768\" data-end=\"2817\">\n<p data-start=\"2770\" data-end=\"2817\">La distance entre l\u2019ancien et le nouveau site ;<\/p>\n<\/li>\n<li data-start=\"2818\" data-end=\"2885\">\n<p data-start=\"2820\" data-end=\"2885\">Les cons\u00e9quences sur la vie familiale (garde d\u2019enfants, sant\u00e9\u2026) ;<\/p>\n<\/li>\n<li data-start=\"2886\" data-end=\"2934\">\n<p data-start=\"2888\" data-end=\"2934\">L\u2019absence de compensation ou d\u2019accompagnement.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2936\" data-end=\"3055\">Les juges op\u00e8rent un <strong data-start=\"2960\" data-end=\"2992\">contr\u00f4le de proportionnalit\u00e9<\/strong> entre les imp\u00e9ratifs de l\u2019entreprise et les droits du salari\u00e9.<\/p>\n<h2 data-start=\"3057\" data-end=\"3127\"><b>Clauses particuli\u00e8res : mobilit\u00e9s internationales et t\u00e9l\u00e9travail<\/b><\/h2>\n<p data-start=\"3129\" data-end=\"3404\">La mobilit\u00e9 \u00e0 l\u2019international ou le passage forc\u00e9 au t\u00e9l\u00e9travail ne peuvent pas \u00eatre impos\u00e9s simplement par une clause de mobilit\u00e9 classique. <strong data-start=\"3271\" data-end=\"3321\">Ces situations exigent des clauses sp\u00e9cifiques<\/strong>, d\u00e9taillant les conditions mat\u00e9rielles, logistiques et financi\u00e8res de la mutation.<\/p>\n<p data-start=\"3406\" data-end=\"3581\">Par exemple : un salari\u00e9 mut\u00e9 en Espagne ou contraint de passer \u00e0 100 % en t\u00e9l\u00e9travail devra donner son accord explicite, m\u00eame en pr\u00e9sence d\u2019une clause de mobilit\u00e9 \u00e9tendue.<br \/><br \/><\/p>\n<p data-start=\"3640\" data-end=\"3854\">La clause de mobilit\u00e9 doit \u00eatre mani\u00e9e avec prudence.
