Il arrive fr\u00e9quemment qu\u2019un employeur propose un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e (CDI) \u00e0 l\u2019issue du CDD. Mais que se passe-t-il lorsque le salari\u00e9 refuse cette proposition ? Quelles sont les cons\u00e9quences pour lui\u2026 et pour l\u2019entreprise ?\u00a0<\/p>\n<h2 data-start=\"576\" data-end=\"621\"><strong>Le contexte juridique du refus d\u2019un CDI<\/strong><\/h2>\n<p data-start=\"623\" data-end=\"883\">Depuis l\u2019entr\u00e9e en vigueur de la loi du 21 d\u00e9cembre 2022 dite \u00ab march\u00e9 du travail \u00bb, le refus d\u2019un CDI \u00e0 l\u2019issue d\u2019un CDD ou d\u2019un contrat d\u2019int\u00e9rim peut avoir des cons\u00e9quences importantes sur les droits du salari\u00e9, notamment en mati\u00e8re d\u2019indemnisation ch\u00f4mage.<\/p>\n<p data-start=\"885\" data-end=\"1040\">Cette disposition vise \u00e0 <strong data-start=\"910\" data-end=\"949\">limiter le recours excessif aux CDD<\/strong> et \u00e0 <strong data-start=\"955\" data-end=\"984\">favoriser l\u2019emploi stable<\/strong>, tout en responsabilisant les salari\u00e9s sur leurs choix.<\/p>\n<h2 data-start=\"1042\" data-end=\"1095\"><strong>Conditions de validit\u00e9 de la proposition de CDI<\/strong><\/h2>\n<p data-start=\"1097\" data-end=\"1281\">Pour que le refus d\u2019un CDI produise des effets juridiques, <strong data-start=\"1156\" data-end=\"1206\">la proposition doit remplir plusieurs crit\u00e8res<\/strong>, strictement encadr\u00e9s par la loi (article L1243-11-1 du Code du travail) :<\/p>\n<ul data-start=\"1283\" data-end=\"1519\">\n<li data-start=\"1283\" data-end=\"1314\">\n<p data-start=\"1285\" data-end=\"1314\"><strong data-start=\"1285\" data-end=\"1312\">\u00catre formul\u00e9e par \u00e9crit<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"1283\" data-end=\"1314\">\n<p data-start=\"1285\" data-end=\"1314\"><strong data-start=\"1317\" data-end=\"1362\">Proposer un emploi identique ou similaire<\/strong> \u00e0 celui exerc\u00e9 en CDD ;<\/p>\n<\/li>\n<li data-start=\"1387\" data-end=\"1451\">\n<p data-start=\"1389\" data-end=\"1451\"><strong data-start=\"1389\" data-end=\"1449\">Avec une r\u00e9mun\u00e9ration et un temps de travail \u00e9quivalents<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"1452\" data-end=\"1519\">\n<p data-start=\"1454\" data-end=\"1519\"><strong data-start=\"1454\" data-end=\"1518\">Et \u00eatre transmise avant la fin du contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1521\" data-end=\"1648\">L\u2019employeur doit laisser au salari\u00e9 un d\u00e9lai raisonnable pour r\u00e9pondre. Le refus doit, lui aussi, \u00eatre <strong data-start=\"1624\" data-end=\"1647\">formalis\u00e9 par \u00e9crit<\/strong>.<\/p>\n<h2 data-start=\"1650\" data-end=\"1694\"><strong>Quelles cons\u00e9quences pour le salari\u00e9 ?<\/strong><\/h2>\n<p data-start=\"1696\" data-end=\"1901\">Lorsque ces conditions sont r\u00e9unies, <strong data-start=\"1733\" data-end=\"1812\">le salari\u00e9 qui refuse le CDI se voit priv\u00e9 de l\u2019indemnit\u00e9 de fin de contrat<\/strong> (dite indemnit\u00e9 de pr\u00e9carit\u00e9, normalement \u00e9gale \u00e0 10 % de la r\u00e9mun\u00e9ration brute per\u00e7ue).<\/p>\n<p data-start=\"1903\" data-end=\"2014\">Mais depuis 2023, il y a plus : <strong data-start=\"1935\" data-end=\"2013\">le refus peut \u00e9galement entra\u00eener une perte du droit \u00e0 l\u2019assurance ch\u00f4mage<\/strong>.<\/p>\n<p data-start=\"2016\" data-end=\"2281\">En effet, <strong data-start=\"2026\" data-end=\"2119\">P\u00f4le emploi peut consid\u00e9rer que le salari\u00e9 s\u2019est volontairement priv\u00e9 d\u2019un emploi durable<\/strong>, ce qui constitue un motif de refus d\u2019indemnisation, sauf \u00e0 d\u00e9montrer un motif l\u00e9gitime (d\u00e9m\u00e9nagement, changement de projet professionnel, situation familiale\u2026).<\/p>\n<h2 data-start=\"2283\" data-end=\"2327\"><strong>Quelles obligations pour l\u2019employeur ?<\/strong><\/h2>\n<p data-start=\"2329\" data-end=\"2379\">Pour \u00e9viter tout litige, l\u2019employeur a int\u00e9r\u00eat \u00e0 :<\/p>\n<ul data-start=\"2381\" data-end=\"2626\">\n<li data-start=\"2381\" data-end=\"2445\">\n<p data-start=\"2383\" data-end=\"2445\"><strong data-start=\"2383\" data-end=\"2443\">Formuler la proposition de CDI par \u00e9crit, avec pr\u00e9cision<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"2446\" data-end=\"2534\">\n<p data-start=\"2448\" data-end=\"2534\"><strong data-start=\"2448\" data-end=\"2502\">Conserver la preuve de la transmission et du refus<\/strong> (email, courrier sign\u00e9, etc.) ;<\/p>\n<\/li>\n<li data-start=\"2535\" data-end=\"2626\">\n<p data-start=\"2537\" data-end=\"2626\"><strong data-start=\"2537\" data-end=\"2625\">Respecter scrupuleusement les crit\u00e8res de similitude de poste, temps et r\u00e9mun\u00e9ration<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2628\" data-end=\"2773\">Un manquement sur l\u2019un de ces points pourrait priver la clause de ses effets et donner lieu \u00e0 des contestations devant le conseil de prud\u2019hommes.<\/p>\n<h2 data-start=\"2775\" data-end=\"2819\"><strong>Que faire en cas de refus du salari\u00e9 ?<\/strong><\/h2>\n<p data-start=\"2821\" data-end=\"2992\">Le refus d\u2019un CDI n\u2019est pas interdit : <strong data-start=\"2860\" data-end=\"2917\">le salari\u00e9 reste libre d\u2019accepter ou non une embauche<\/strong>, tant que ce choix est \u00e9clair\u00e9 et encadr\u00e9 juridiquement. En cas de refus :<\/p>\n<ul data-start=\"2994\" data-end=\"3194\">\n<li data-start=\"2994\" data-end=\"3040\">\n<p data-start=\"2996\" data-end=\"3040\">L\u2019employeur <strong data-start=\"3008\" data-end=\"3038\">met fin au CDD \u00e0 son terme<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"3041\" data-end=\"3117\">\n<p data-start=\"3043\" data-end=\"3117\">Il <strong data-start=\"3046\" data-end=\"3099\">n\u2019est pas tenu de verser l\u2019indemnit\u00e9 de pr\u00e9carit\u00e9<\/strong>, sauf exception ;<\/p>\n<\/li>\n<li data-start=\"3118\" data-end=\"3194\">\n<p data-start=\"3120\" data-end=\"3194\">Il peut <strong data-start=\"3128\" data-end=\"3193\">recruter un autre salari\u00e9, en CDI ou en CDD selon les besoins<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3196\" data-end=\"3334\">Il n\u2019est en revanche <strong data-start=\"3217\" data-end=\"3273\">pas possible de sanctionner le salari\u00e9 pour ce refus<\/strong>, ni de lui interdire de candidater \u00e0 nouveau ult\u00e9rieurement.<\/p>\n<p data-start=\"3196\" data-end=\"3334\">\u00a0<\/p>\n<p data-start=\"3354\" data-end=\"3553\">Le refus d\u2019un CDI \u00e0 l\u2019issue d\u2019un CDD est un acte lourd de cons\u00e9quences.
