La r\u00e9ponse est claire : <strong data-start=\"700\" data-end=\"818\">non, une clause de non-concurrence ne peut pas \u00eatre impos\u00e9e unilat\u00e9ralement apr\u00e8s la rupture du contrat de travail<\/strong>. Pour \u00eatre valable, elle doit avoir \u00e9t\u00e9 <strong data-start=\"859\" data-end=\"993\">anticip\u00e9e, encadr\u00e9e juridiquement et accept\u00e9e par le salari\u00e9 au moment de son engagement ou dans un avenant sign\u00e9 avant son d\u00e9part<\/strong>.<\/p>\n<h2 data-start=\"996\" data-end=\"1043\">Qu\u2019est-ce qu\u2019une clause de non-concurrence ?<\/h2>\n<p data-start=\"1045\" data-end=\"1315\">La clause de non-concurrence vise \u00e0 <strong data-start=\"1081\" data-end=\"1141\">emp\u00eacher un salari\u00e9 de concurrencer son ancien employeur<\/strong> apr\u00e8s la fin de son contrat, en travaillant pour un concurrent ou en cr\u00e9ant une activit\u00e9 similaire. Elle doit cependant respecter des crit\u00e8res tr\u00e8s stricts pour \u00eatre valide.<\/p>\n<p data-start=\"1317\" data-end=\"1451\">Selon la jurisprudence constante de la Cour de cassation, pour qu\u2019une clause de non-concurrence soit opposable au salari\u00e9, elle doit :<\/p>\n<ul data-start=\"1453\" data-end=\"1749\">\n<li data-start=\"1453\" data-end=\"1531\">\n<p data-start=\"1455\" data-end=\"1531\">\u00catre <strong data-start=\"1460\" data-end=\"1482\">pr\u00e9cis\u00e9e par \u00e9crit<\/strong> dans le contrat de travail ou un avenant sign\u00e9 ;<\/p>\n<\/li>\n<li data-start=\"1532\" data-end=\"1578\">\n<p data-start=\"1534\" data-end=\"1578\">\u00catre <strong data-start=\"1539\" data-end=\"1576\">limit\u00e9e dans le temps et l\u2019espace<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"1579\" data-end=\"1644\">\n<p data-start=\"1581\" data-end=\"1644\">\u00catre <strong data-start=\"1586\" data-end=\"1642\">proportionn\u00e9e aux int\u00e9r\u00eats l\u00e9gitimes de l\u2019entreprise<\/strong> ;<\/p>\n<\/li>\n<li data-start=\"1645\" data-end=\"1749\">\n<p data-start=\"1647\" data-end=\"1749\">Faire l\u2019objet d\u2019une <strong data-start=\"1667\" data-end=\"1701\">contrepartie financi\u00e8re r\u00e9elle<\/strong>, vers\u00e9e au salari\u00e9 apr\u00e8s la rupture du contrat.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"1751\" data-end=\"1793\">Peut-on l\u2019imposer apr\u00e8s une d\u00e9mission ?<\/h2>\n<p data-start=\"1795\" data-end=\"2199\"><strong data-start=\"1795\" data-end=\"1912\">Non. Une clause de non-concurrence ne peut jamais \u00eatre impos\u00e9e apr\u00e8s coup, une fois que le salari\u00e9 a d\u00e9missionn\u00e9.<\/strong> En d\u2019autres termes, si aucune clause n\u2019\u00e9tait pr\u00e9vue dans le contrat initial ou dans un avenant sign\u00e9 avant la fin du contrat, il est trop tard pour l\u2019ajouter. Tenter de le faire exposerait l\u2019employeur \u00e0 des risques juridiques importants, notamment pour atteinte \u00e0 la libert\u00e9 du travail.<\/p>\n<p data-start=\"2201\" data-end=\"2458\">Le salari\u00e9 ne peut \u00eatre li\u00e9 \u00e0 une obligation de non-concurrence <strong data-start=\"2265\" data-end=\"2370\">que s\u2019il a donn\u00e9 son accord \u00e9clair\u00e9, formalis\u00e9 par \u00e9crit, et s\u2019il per\u00e7oit une contrepartie financi\u00e8re<\/strong>. \u00c0 d\u00e9faut, toute tentative d\u2019imposition unilat\u00e9rale serait r\u00e9put\u00e9e nulle et sans effet.<\/p>\n<h2 data-start=\"2460\" data-end=\"2513\">Et si le salari\u00e9 est d\u2019accord apr\u00e8s la d\u00e9mission ?<\/h2>\n<p data-start=\"2515\" data-end=\"2799\">Dans certains cas, un salari\u00e9 peut accepter de signer une clause de non-concurrence apr\u00e8s avoir donn\u00e9 sa d\u00e9mission. <strong data-start=\"2631\" data-end=\"2745\">Mais m\u00eame dans ce cas, la clause ne peut \u00eatre valable que si elle remplit les conditions de validit\u00e9 pr\u00e9cit\u00e9es<\/strong>, notamment l\u2019existence d\u2019une contrepartie financi\u00e8re.<\/p>\n<p data-start=\"2801\" data-end=\"2951\">Il ne s\u2019agit donc plus d\u2019une clause impos\u00e9e, mais <strong data-start=\"2851\" data-end=\"2887\">d\u2019un accord contractuel distinct<\/strong>, qui devra \u00eatre parfaitement r\u00e9dig\u00e9, dat\u00e9, sign\u00e9, et \u00e9quilibr\u00e9.<\/p>\n<h2 data-start=\"2953\" data-end=\"3002\">Notre conseil : anticipez, s\u00e9curisez, encadrez<\/h2>\n<p data-start=\"3004\" data-end=\"3229\">Chez Avocat Desrumaux, nous insistons sur un principe cl\u00e9 : <strong data-start=\"3064\" data-end=\"3114\">la s\u00e9curit\u00e9 juridique passe par l\u2019anticipation<\/strong>.
