Mais que faire lorsqu\u2019un employeur estime que la dur\u00e9e de l\u2019arr\u00eat est excessive ou injustifi\u00e9e ? Peut-il demander une r\u00e9\u00e9valuation ind\u00e9pendante ? Et comment agir si la CPAM ne coop\u00e8re pas ? Une d\u00e9cision r\u00e9cente de la cour d\u2019appel de Lyon apporte des \u00e9l\u00e9ments de r\u00e9ponse concrets.<\/p>\n<p class=\"\" data-start=\"728\" data-end=\"801\"><strong data-start=\"728\" data-end=\"801\">Le cadre juridique : arr\u00eat maladie professionnelle et r\u00f4le de la CPAM<\/strong><\/p>\n<p class=\"\" data-start=\"803\" data-end=\"1268\">La reconnaissance d\u2019une maladie professionnelle ouvre droit \u00e0 une indemnisation renforc\u00e9e pour le salari\u00e9, financ\u00e9e par la branche AT\/MP de la S\u00e9curit\u00e9 sociale. L\u2019article L. 461-1 du Code de la s\u00e9curit\u00e9 sociale d\u00e9finit les conditions de cette reconnaissance. Une fois admise, l\u2019arr\u00eat de travail est indemnis\u00e9 sans d\u00e9lai de carence et sans conditions d\u2019ouverture de droits. Toutefois, la CPAM reste seule juge de la prise en charge, y compris de la dur\u00e9e de l\u2019arr\u00eat.<\/p>\n<p class=\"\" data-start=\"1270\" data-end=\"1667\">L\u2019employeur n\u2019a pas acc\u00e8s au dossier m\u00e9dical du salari\u00e9, mais peut contester la d\u00e9cision devant la Commission de recours amiable, puis devant le p\u00f4le social du tribunal judiciaire. Il peut aussi demander une expertise judiciaire sur la r\u00e9alit\u00e9 du lien entre l\u2019arr\u00eat et la pathologie d\u00e9clar\u00e9e. Cette voie est particuli\u00e8rement utile lorsque l\u2019employeur soup\u00e7onne une prolongation abusive de l\u2019arr\u00eat.<\/p>\n<p class=\"\" data-start=\"1669\" data-end=\"1732\"><strong data-start=\"1669\" data-end=\"1732\">Une affaire r\u00e9cente : deux ans d\u2019arr\u00eat r\u00e9duits \u00e0 trois mois<\/strong><\/p>\n<p class=\"\" data-start=\"1734\" data-end=\"2083\">Dans un arr\u00eat du 4 mars 2025, la cour d\u2019appel de Lyon (CA Lyon, 4 mars 2025, n\u00b0 RG \u00e0 pr\u00e9ciser) a \u00e9t\u00e9 saisie d\u2019un litige opposant une PME \u00e0 la CPAM, \u00e0 propos d\u2019un arr\u00eat maladie professionnelle de plus de deux ans pour t\u00e9nosynovite. L\u2019employeur contestait la dur\u00e9e de l\u2019arr\u00eat, estimant qu\u2019elle ne se justifiait pas au regard de la pathologie en cause.<\/p>\n<p class=\"\" data-start=\"2085\" data-end=\"2650\">Le juge a ordonn\u00e9 une expertise judiciaire sur pi\u00e8ces, afin d\u2019\u00e9valuer si l\u2019int\u00e9gralit\u00e9 de l\u2019arr\u00eat \u00e9tait bien imputable \u00e0 la maladie reconnue. L\u2019expert a conclu que seuls trois mois \u00e9taient directement li\u00e9s \u00e0 la pathologie initiale. Fait notable : la CPAM a refus\u00e9 de transmettre certains \u00e9l\u00e9ments du dossier m\u00e9dical \u00e0 l\u2019expert, compromettant ainsi sa propre position. La cour d\u2019appel a confirm\u00e9 le rapport d\u2019expertise et d\u00e9bout\u00e9 la CPAM, consid\u00e9rant qu\u2019elle ne pouvait utilement critiquer des conclusions qu\u2019elle avait emp\u00each\u00e9es de se fonder sur un dossier complet.<\/p>\n<p class=\"\" data-start=\"2652\" data-end=\"2691\"><strong data-start=\"2652\" data-end=\"2691\">Cons\u00e9quences pratiques pour les PME<\/strong><\/p>\n<p class=\"\" data-start=\"2693\" data-end=\"3084\">Cette affaire illustre qu\u2019un employeur n\u2019est pas totalement d\u00e9muni face \u00e0 une d\u00e9cision de la CPAM qu\u2019il juge excessive. Il peut agir et demander un r\u00e9examen judiciaire, notamment par voie d\u2019expertise. Cela peut permettre de r\u00e9tablir une \u00e9valuation plus objective de la situation m\u00e9dicale du salari\u00e9, et de limiter les effets d\u2019un arr\u00eat prolong\u00e9 injustifi\u00e9 sur l\u2019organisation de l\u2019entreprise.<\/p>\n<p class=\"\" data-start=\"3086\" data-end=\"3392\">En pratique, ce type de recours peut \u00eatre envisag\u00e9 lorsque l\u2019employeur dispose d\u2019\u00e9l\u00e9ments factuels laissant supposer une d\u00e9connexion entre l\u2019arr\u00eat et la pathologie d\u00e9clar\u00e9e : dur\u00e9e disproportionn\u00e9e, avis m\u00e9dical divergent, \u00e9volution professionnelle ou comportement du salari\u00e9 en contradiction avec l\u2019arr\u00eat.<\/p>\n<p class=\"\" data-start=\"3394\" data-end=\"3417\"><strong data-start=\"3394\" data-end=\"3417\">Conseil de l\u2019avocat<\/strong><\/p>\n<p class=\"\" data-start=\"3419\" data-end=\"3506\">Pour s\u00e9curiser ce type de contentieux, il est essentiel d\u2019anticiper. L\u2019employeur doit :<\/p>\n<ul data-start=\"3507\" data-end=\"3981\">\n<li class=\"\" data-start=\"3507\" data-end=\"3621\">\n<p class=\"\" data-start=\"3509\" data-end=\"3621\">conserver toute la documentation relative \u00e0 l\u2019arr\u00eat (dates, certificats m\u00e9dicaux, correspondances avec la CPAM),<\/p>\n<\/li>\n<li class=\"\" data-start=\"3622\" data-end=\"3695\">\n<p class=\"\" data-start=\"3624\" data-end=\"3695\">solliciter un avis m\u00e9dical contradictoire s\u2019il existe un doute s\u00e9rieux,<\/p>\n<\/li>\n<li class=\"\" data-start=\"3696\" data-end=\"3817\">\n<p class=\"\" data-start=\"3698\" data-end=\"3817\">faire appel \u00e0 un avocat pour engager la proc\u00e9dure devant le tribunal judiciaire, avec demande d\u2019expertise ind\u00e9pendante,<\/p>\n<\/li>\n<li class=\"\" data-start=\"3818\" data-end=\"3909\">\n<p class=\"\" data-start=\"3820\" data-end=\"3909\">insister, lors de l\u2019expertise, sur la n\u00e9cessit\u00e9 d\u2019acc\u00e8s aux pi\u00e8ces m\u00e9dicales pertinentes,<\/p>\n<\/li>\n<li class=\"\" data-start=\"3910\" data-end=\"3981\">\n<p class=\"\" data-start=\"3912\" data-end=\"3981\">et veiller au respect du contradictoire tout au long de la proc\u00e9dure.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3983\" data-end=\"4188\">Cette d\u00e9marche, bien que juridiquement complexe, peut aboutir \u00e0 une r\u00e9duction significative de la dur\u00e9e prise en charge au titre de l\u2019AT\/MP, avec des cons\u00e9quences financi\u00e8res importantes pour l\u2019entreprise.<\/p>\n<p class=\"\" data-start=\"4190\" data-end=\"4215\"><strong data-start=\"4190\" data-end=\"4215\">R\u00e9f\u00e9rences juridiques<\/strong><\/p>\n<p class=\"\" data-start=\"4217\" data-end=\"4343\">Code de la s\u00e9curit\u00e9 sociale, article L. 461-1<br data-start=\"4262\" data-end=\"4265\" \/>Cour d\u2019appel de Lyon, 4 mars 2025 (r\u00e9f\u00e9rence RG \u00e0 compl\u00e9ter selon publication)<\/p>\n<p class=\"\" data-start=\"4345\" data-end=\"4359\"><strong data-start=\"4345\" data-end=\"4359\">Conclusion<\/strong><\/p>\n<p class=\"\" data-start=\"4361\" data-end=\"4761\">Un arr\u00eat maladie d\u2019origine professionnelle n\u2019est pas toujours incontestable. Lorsqu\u2019un doute s\u00e9rieux existe sur sa dur\u00e9e, l\u2019entreprise a la possibilit\u00e9 d\u2019agir et de demander une expertise judiciaire. Cette d\u00e9marche, bien men\u00e9e, peut aboutir \u00e0 une d\u00e9cision plus \u00e9quilibr\u00e9e, notamment si la CPAM manque \u00e0 son obligation de coop\u00e9ration.
