Yet they can play a decisive role in the day-to-day organization and legal security of small and medium-sized businesses. As an employer, you may not yet be legally bound by them, but adopting one now can greatly enhance your company&#8217;s internal stability and secure your HR practices.  <\/p>\n<p class=\"\" data-start=\"872\" data-end=\"965\"><strong data-start=\"872\" data-end=\"965\">Internal regulations: a clear framework for enforcing company rules<\/strong><\/p>\n<p class=\"\" data-start=\"967\" data-end=\"1160\">The internal regulations are a written document drawn up by the employer, setting out the rules applicable to health, safety, discipline and working conditions. They must be drawn up, submitted to the CSE for approval, then forwarded to the Labour Inspectorate. <\/p>\n<p class=\"\" data-start=\"1843\" data-end=\"1975\">But even below this threshold, many SMEs voluntarily choose to adopt it, as it offers them several advantages:<\/p>\n<ul data-start=\"1976\" data-end=\"2213\">\n<li class=\"\" data-start=\"1976\" data-end=\"2047\">\n<p class=\"\" data-start=\"1978\" data-end=\"2047\">define a common set of rules, particularly in disciplinary matters<\/p>\n<\/li>\n<li class=\"\" data-start=\"2048\" data-end=\"2112\">\n<p class=\"\" data-start=\"2050\" data-end=\"2112\">avoid arbitrary management of deviant behavior<\/p>\n<\/li>\n<li class=\"\" data-start=\"2113\" data-end=\"2213\">\n<p class=\"\" data-start=\"2115\" data-end=\"2213\">demonstrate, in the event of litigation, that employees had been properly informed of the rules in force<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2215\" data-end=\"2282\"><strong data-start=\"2215\" data-end=\"2282\">A tool for preventing disputes and ensuring legal certainty<\/strong><\/p>\n<p class=\"\" data-start=\"2284\" data-end=\"2561\">In the event of disciplinary disputes or industrial tribunal litigation, having internal regulations in place can make all the difference. Employers can only punish employees if they have been informed in advance of the applicable rules and penalties. <\/p>\n<p class=\"\" data-start=\"2563\" data-end=\"2608\">Thus, the existence of internal regulations :<\/p>\n<ul data-start=\"2609\" data-end=\"2870\">\n<li class=\"\" data-start=\"2609\" data-end=\"2691\">\n<p class=\"\" data-start=\"2611\" data-end=\"2691\"><strong data-start=\"2621\" data-end=\"2661\">justifies a disciplinary sanction<\/strong> (warning, suspension, etc.)<\/p>\n<\/li>\n<li class=\"\" data-start=\"2692\" data-end=\"2780\">\n<p class=\"\" data-start=\"2694\" data-end=\"2780\">protects the company against accusations of discriminatory or arbitrary treatment<\/p>\n<\/li>\n<li class=\"\" data-start=\"2781\" data-end=\"2870\">\n<p class=\"\" data-start=\"2783\" data-end=\"2870\">facilitates dialogue with employee representatives by providing a clear basis for discussion<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2872\" data-end=\"2912\"><strong data-start=\"2872\" data-end=\"2912\">Why SMEs stand to gain<\/strong><\/p>\n<p class=\"\" data-start=\"2914\" data-end=\"3154\">In an SME, where hierarchical links are often more direct, a written document formalizing internal rules helps to<strong data-start=\"3032\" data-end=\"3057\">align practices<\/strong>, guarantee fair treatment between employees, and streamline day-to-day management.<\/p>\n<p class=\"\" data-start=\"3156\" data-end=\"3219\">In concrete terms, a well-structured set of internal regulations makes it possible to :<\/p>\n<ul data-start=\"3220\" data-end=\"3495\">\n<li class=\"\" data-start=\"3220\" data-end=\"3283\">\n<p class=\"\" data-start=\"3222\" data-end=\"3283\"><strong data-start=\"3222\" data-end=\"3264\">avoid different interpretations<\/strong> by different managers<\/p>\n<\/li>\n<li class=\"\" data-start=\"3284\" data-end=\"3421\">\n<p class=\"\" data-start=\"3286\" data-end=\"3421\">establish a <strong data-start=\"3295\" data-end=\"3312\">shared framework<\/strong> for the rules governing the use of digital tools, break times, alcohol and business telephones<\/p>\n<\/li>\n<li class=\"\" data-start=\"3422\" data-end=\"3495\">\n<p class=\"\" data-start=\"3424\" data-end=\"3495\">anchoring <strong data-start=\"3434\" data-end=\"3458\">corporate culture<\/strong> in visible, accepted rules<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3497\" data-end=\"3628\">It&#8217;s also an invaluable support for onboarding new employees, and a cornerstone for any structured HR communication.<\/p>\n<p class=\"\" data-start=\"3630\" data-end=\"3689\"><strong data-start=\"3630\" data-end=\"3689\">How do you set up internal rules for SMEs?<\/strong><\/p>\n<p class=\"\" data-start=\"3691\" data-end=\"3714\">Here are the key steps:<\/p>\n<ol data-start=\"3716\" data-end=\"4769\">\n<li class=\"\" data-start=\"3716\" data-end=\"3976\">\n<p class=\"\" data-start=\"3719\" data-end=\"3976\"><strong data-start=\"3719\" data-end=\"3774\">Define your company&#8217;s specific needs<\/strong> Depending on your sector (industry, services, shift work, etc.), certain issues will need to be prioritized: safety, clothing, use of equipment, confidentiality, etc.<\/p>\n<\/li>\n<li class=\"\" data-start=\"3978\" data-end=\"4177\">\n<p class=\"\" data-start=\"3981\" data-end=\"4177\"><strong data-start=\"3981\" data-end=\"4030\">The<\/strong> content must comply with the general principles of law, and contain no discriminatory clauses or provisions contrary to the law.<\/p>\n<\/li>\n<li class=\"\" data-start=\"4179\" data-end=\"4388\">\n<p class=\"\" data-start=\"4182\" data-end=\"4388\"><strong data-start=\"4182\" data-end=\"4225\">Involving employee representatives<\/strong> If a CSE is in place, the committee&#8217;s opinion is required prior to implementation. Even without a CSE, it is advisable to organize clear communication with employees. <\/p>\n<\/li>\n<li class=\"\" data-start=\"4390\" data-end=\"4555\">\n<p class=\"\" data-start=\"4393\" data-end=\"4555\"><strong data-start=\"4393\" data-end=\"4418\">Disseminate the rules<\/strong> Posting, handing them out on hiring, making them available on the intranet&#8230; Every employee must be able to read them at any time.<\/p>\n<\/li>\n<li class=\"\" data-start=\"4557\" data-end=\"4769\">\n<p class=\"\" data-start=\"4560\" data-end=\"4769\"><strong data-start=\"4560\" data-end=\"4601\">Follow and update regularly<\/strong> Any changes must follow the same procedure.
