Pour un employeur, c\u2019est un moyen strat\u00e9gique de cadrer les r\u00e8gles du jeu, de pr\u00e9venir les litiges et de garantir une coh\u00e9rence disciplinaire dans l\u2019entreprise. Mais pour \u00eatre juridiquement valable et op\u00e9rationnel, ce document doit comporter certaines clauses cl\u00e9s. Quelles sont-elles ? Et comment s\u2019assurer qu\u2019elles r\u00e9pondent \u00e0 la fois aux obligations du Code du travail et aux r\u00e9alit\u00e9s de votre PME ?<\/p>\n<p class=\"\" data-start=\"1005\" data-end=\"1074\"><strong data-start=\"1005\" data-end=\"1074\">Un outil RH indispensable d\u00e8s 50 salari\u00e9s \u2013 mais utile bien avant<\/strong><\/p>\n<p class=\"\" data-start=\"1076\" data-end=\"1246\">Le r\u00e8glement int\u00e9rieur est obligatoire pour toute entreprise de <strong data-start=\"1140\" data-end=\"1163\">50 salari\u00e9s et plus<\/strong> (article L1311-2 du Code du travail). Il fixe, par \u00e9crit, les r\u00e8gles relatives \u00e0 :<\/p>\n<ul data-start=\"1247\" data-end=\"1368\">\n<li class=\"\" data-start=\"1247\" data-end=\"1283\">\n<p class=\"\" data-start=\"1249\" data-end=\"1283\">la sant\u00e9 et la s\u00e9curit\u00e9 au travail<\/p>\n<\/li>\n<li class=\"\" data-start=\"1284\" data-end=\"1328\">\n<p class=\"\" data-start=\"1286\" data-end=\"1328\">la discipline et les sanctions applicables<\/p>\n<\/li>\n<li class=\"\" data-start=\"1329\" data-end=\"1368\">\n<p class=\"\" data-start=\"1331\" data-end=\"1368\">les droits et obligations r\u00e9ciproques<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1370\" data-end=\"1627\">Mais m\u00eame <strong data-start=\"1380\" data-end=\"1406\">en dessous de ce seuil<\/strong>, nombre de PME choisissent de le mettre en place volontairement. Pourquoi ? Parce qu\u2019il offre un <strong data-start=\"1504\" data-end=\"1544\">cadre clair, opposable et s\u00e9curisant<\/strong>, utile en cas de contentieux, d\u2019accident du travail, ou de sanction disciplinaire.<\/p>\n<p class=\"\" data-start=\"1629\" data-end=\"1692\"><strong data-start=\"1629\" data-end=\"1692\">Clause 1 : les consignes en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9<\/strong><\/p>\n<p class=\"\" data-start=\"1694\" data-end=\"1993\">Cette clause est obligatoire. Elle doit pr\u00e9ciser les r\u00e8gles que chaque salari\u00e9 est tenu de respecter pour pr\u00e9venir les accidents et garantir un environnement de travail s\u00fbr : port d\u2019\u00e9quipements de protection, interdictions (alcool, t\u00e9l\u00e9phone en zone de production\u2026), respect des proc\u00e9dures internes.<\/p>\n<p class=\"\" data-start=\"1995\" data-end=\"2158\">En cas d\u2019inspection du travail, ce point est syst\u00e9matiquement contr\u00f4l\u00e9. Il sert \u00e9galement de fondement en cas de mise en cause de la responsabilit\u00e9 de l\u2019employeur.<\/p>\n<p class=\"\" data-start=\"2160\" data-end=\"2205\"><strong data-start=\"2160\" data-end=\"2205\">Clause 2 : la discipline et les sanctions<\/strong><\/p>\n<p class=\"\" data-start=\"2207\" data-end=\"2409\">Autre \u00e9l\u00e9ment central : les r\u00e8gles de conduite \u00e0 respecter (ponctualit\u00e9, comportement, usage des outils num\u00e9riques\u2026) et les sanctions encourues en cas d\u2019\u00e9cart (avertissement, mise \u00e0 pied, licenciement).<\/p>\n<p class=\"\" data-start=\"2411\" data-end=\"2639\">Pour \u00eatre juridiquement applicables, <strong data-start=\"2448\" data-end=\"2499\">ces sanctions doivent figurer dans le r\u00e8glement<\/strong>, ou avoir \u00e9t\u00e9 port\u00e9es \u00e0 la connaissance du salari\u00e9. Cette clause \u00e9vite donc les contestations sur la l\u00e9gitimit\u00e9 d\u2019une mesure disciplinaire.<\/p>\n<p class=\"\" data-start=\"2641\" data-end=\"2704\"><strong data-start=\"2641\" data-end=\"2704\">Clause 3 : les droits des salari\u00e9s et garanties collectives<\/strong><\/p>\n<p class=\"\" data-start=\"2706\" data-end=\"2844\">Le r\u00e8glement int\u00e9rieur ne doit pas \u00eatre un outil \u00e0 sens unique. Il doit \u00e9galement rappeler certains <strong data-start=\"2806\" data-end=\"2842\">droits fondamentaux des salari\u00e9s<\/strong> :<\/p>\n<ul data-start=\"2845\" data-end=\"2976\">\n<li class=\"\" data-start=\"2845\" data-end=\"2899\">\n<p class=\"\" data-start=\"2847\" data-end=\"2899\">respect de la vie priv\u00e9e et des donn\u00e9es personnelles<\/p>\n<\/li>\n<li class=\"\" data-start=\"2900\" data-end=\"2923\">\n<p class=\"\" data-start=\"2902\" data-end=\"2923\">\u00e9galit\u00e9 de traitement<\/p>\n<\/li>\n<li class=\"\" data-start=\"2924\" data-end=\"2959\">\n<p class=\"\" data-start=\"2926\" data-end=\"2959\">libert\u00e9 d\u2019expression et d\u2019opinion<\/p>\n<\/li>\n<li class=\"\" data-start=\"2960\" data-end=\"2976\">\n<p class=\"\" data-start=\"2962\" data-end=\"2976\">droit syndical<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2978\" data-end=\"3123\">En les int\u00e9grant dans le r\u00e8glement, vous d\u00e9montrez une volont\u00e9 d\u2019\u00e9quilibre et vous s\u00e9curisez votre posture en cas de contestation sur ces sujets.<\/p>\n<p class=\"\" data-start=\"3125\" data-end=\"3179\"><strong data-start=\"3125\" data-end=\"3179\">Clause 4 : hygi\u00e8ne et bonnes pratiques collectives<\/strong><\/p>\n<p class=\"\" data-start=\"3181\" data-end=\"3479\">Dans le contexte post-COVID, int\u00e9grer des r\u00e8gles relatives \u00e0 l\u2019hygi\u00e8ne (entretien des locaux, usage des sanitaires, comportements attendus en p\u00e9riode d\u2019\u00e9pid\u00e9mie\u2026) est devenu une bonne pratique. Cette clause peut \u00eatre personnalis\u00e9e selon votre activit\u00e9 (manutention, accueil du public, open space\u2026).<\/p>\n<p class=\"\" data-start=\"3481\" data-end=\"3535\"><strong data-start=\"3481\" data-end=\"3535\">Clause 5 : \u00e9volutivit\u00e9 et mise \u00e0 jour du r\u00e8glement<\/strong><\/p>\n<p class=\"\" data-start=\"3537\" data-end=\"3749\">Un bon r\u00e8glement n\u2019est pas fig\u00e9. Il doit pr\u00e9voir la possibilit\u00e9 d\u2019\u00eatre modifi\u00e9 pour s\u2019adapter \u00e0 l\u2019\u00e9volution de la l\u00e9gislation, des outils de travail (t\u00e9l\u00e9travail, cybers\u00e9curit\u00e9, RGPD\u2026) ou des conditions internes.<\/p>\n<p class=\"\" data-start=\"3751\" data-end=\"3894\">Il est recommand\u00e9 de pr\u00e9voir une <strong data-start=\"3784\" data-end=\"3819\">proc\u00e9dure claire de mise \u00e0 jour<\/strong> : consultation du CSE, information des salari\u00e9s, communication accessible.<\/p>\n<p class=\"\" data-start=\"3896\" data-end=\"3955\"><strong data-start=\"3896\" data-end=\"3955\">Conseil de l\u2019avocat : structurez, formalisez, s\u00e9curisez<\/strong><\/p>\n<p class=\"\" data-start=\"3957\" data-end=\"4008\">Pour \u00eatre valable, votre r\u00e8glement int\u00e9rieur doit :<\/p>\n<ul data-start=\"4009\" data-end=\"4289\">\n<li class=\"\" data-start=\"4009\" data-end=\"4106\">\n<p class=\"\" data-start=\"4011\" data-end=\"4106\">respecter le formalisme l\u00e9gal (affichage, d\u00e9p\u00f4t \u00e0 l\u2019inspection du travail, consultation du CSE)<\/p>\n<\/li>\n<li class=\"\" data-start=\"4107\" data-end=\"4185\">\n<p class=\"\" data-start=\"4109\" data-end=\"4185\">\u00eatre r\u00e9dig\u00e9 dans des termes clairs, sans ambigu\u00eft\u00e9 ni clause discriminatoire<\/p>\n<\/li>\n<li class=\"\" data-start=\"4186\" data-end=\"4289\">\n<p class=\"\" data-start=\"4188\" data-end=\"4289\">refl\u00e9ter vos r\u00e9alit\u00e9s op\u00e9rationnelles (secteur d\u2019activit\u00e9, risques sp\u00e9cifiques, culture d\u2019entreprise)<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"4291\" data-end=\"4317\">Le cabinet recommande de :<\/p>\n<ul data-start=\"4318\" data-end=\"4549\">\n<li class=\"\" data-start=\"4318\" data-end=\"4389\">\n<p class=\"\" data-start=\"4320\" data-end=\"4389\">vous faire accompagner pour sa <strong data-start=\"4351\" data-end=\"4388\">r\u00e9daction initiale ou sa r\u00e9vision<\/strong>,<\/p>\n<\/li>\n<li class=\"\" data-start=\"4390\" data-end=\"4467\">\n<p class=\"\" data-start=\"4392\" data-end=\"4467\">former vos managers \u00e0 son contenu, pour garantir une application coh\u00e9rente,<\/p>\n<\/li>\n<li class=\"\" data-start=\"4468\" data-end=\"4549\">\n<p class=\"\" data-start=\"4470\" data-end=\"4549\">pr\u00e9voir une <strong data-start=\"4482\" data-end=\"4500\">revue annuelle<\/strong>, notamment en cas d\u2019\u00e9volution RH ou l\u00e9gislative.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"4551\" data-end=\"4765\"><strong data-start=\"4551\" data-end=\"4625\">Un r\u00e8glement int\u00e9rieur bien r\u00e9dig\u00e9 est un outil de management efficace<\/strong> : il encadre, prot\u00e8ge, et clarifie vos responsabilit\u00e9s.
