Trop souvent n\u00e9glig\u00e9e ou mal encadr\u00e9e, la formation des \u00e9lus du CSE constitue pourtant un levier essentiel de bon fonctionnement du dialogue social et une obligation juridique encadr\u00e9e par le Code du travail. Pour un employeur, il s\u2019agit de comprendre pr\u00e9cis\u00e9ment ce qu\u2019il doit mettre en place, dans quels d\u00e9lais, \u00e0 quelles conditions de financement, et ce qu\u2019il risque en cas de manquement.<\/p>\n<p class=\"\" data-start=\"980\" data-end=\"1045\"><strong data-start=\"980\" data-end=\"1045\">Former les \u00e9lus du CSE : une obligation l\u00e9gale de l\u2019employeur<\/strong><\/p>\n<p class=\"\" data-start=\"1047\" data-end=\"1339\">Dans toute entreprise d\u2019au moins 50 salari\u00e9s, l\u2019employeur est tenu de permettre aux membres titulaires du CSE de b\u00e9n\u00e9ficier d\u2019une <strong data-start=\"1177\" data-end=\"1201\">formation \u00e9conomique<\/strong>. Cette formation est pr\u00e9vue par l\u2019article <strong data-start=\"1244\" data-end=\"1275\">L2315-63 du Code du travail<\/strong>, pour une <strong data-start=\"1286\" data-end=\"1315\">dur\u00e9e minimale de 5 jours<\/strong> lors du premier mandat.<\/p>\n<p class=\"\" data-start=\"1341\" data-end=\"1734\">Par ailleurs, pour tous les membres du CSE, qu\u2019ils soient titulaires ou suppl\u00e9ants, une <strong data-start=\"1429\" data-end=\"1493\">formation en sant\u00e9, s\u00e9curit\u00e9 et conditions de travail (SSCT)<\/strong> doit \u00e9galement \u00eatre organis\u00e9e. Cette formation est obligatoire <strong data-start=\"1557\" data-end=\"1606\">d\u00e8s lors que l\u2019entreprise atteint 11 salari\u00e9s<\/strong>, conform\u00e9ment \u00e0 l\u2019article <strong data-start=\"1633\" data-end=\"1664\">L2315-18 du Code du travail<\/strong>, et sa dur\u00e9e varie de 3 \u00e0 5 jours selon la taille de l\u2019\u00e9tablissement.<\/p>\n<p class=\"\" data-start=\"1736\" data-end=\"2039\">Dans les deux cas, ces formations doivent \u00eatre r\u00e9alis\u00e9es <strong data-start=\"1793\" data-end=\"1839\">dans un d\u00e9lai raisonnable apr\u00e8s l\u2019\u00e9lection<\/strong>, afin de permettre aux \u00e9lus d\u2019exercer effectivement leurs missions. <strong data-start=\"1908\" data-end=\"1988\">Le temps pass\u00e9 en formation est consid\u00e9r\u00e9 comme du temps de travail effectif<\/strong> et ne doit entra\u00eener aucune perte de r\u00e9mun\u00e9ration.<\/p>\n<p class=\"\" data-start=\"2041\" data-end=\"2103\"><strong data-start=\"2041\" data-end=\"2103\">Qui finance la formation des \u00e9lus ? Les r\u00e8gles \u00e0 conna\u00eetre<\/strong><\/p>\n<p class=\"\" data-start=\"2105\" data-end=\"2182\">L\u2019article <strong data-start=\"2115\" data-end=\"2146\">L2315-61 du Code du travail<\/strong> distingue deux types de formation :<\/p>\n<ul data-start=\"2184\" data-end=\"2678\">\n<li class=\"\" data-start=\"2184\" data-end=\"2396\">\n<p class=\"\" data-start=\"2186\" data-end=\"2396\">La formation <strong data-start=\"2199\" data-end=\"2207\">SSCT<\/strong> (sant\u00e9, s\u00e9curit\u00e9 et conditions de travail) est <strong data-start=\"2255\" data-end=\"2297\">enti\u00e8rement \u00e0 la charge de l\u2019employeur<\/strong>. Elle comprend les frais p\u00e9dagogiques, les frais de d\u00e9placement et, le cas \u00e9ch\u00e9ant, d\u2019h\u00e9bergement.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2400\" data-end=\"2678\">\n<p class=\"\" data-start=\"2402\" data-end=\"2678\">La formation <strong data-start=\"2415\" data-end=\"2429\">\u00e9conomique<\/strong>, quant \u00e0 elle, est financ\u00e9e via le <strong data-start=\"2465\" data-end=\"2500\">budget de fonctionnement du CSE<\/strong>, sauf accord plus favorable. Il est donc essentiel pour l\u2019employeur d\u2019informer les \u00e9lus de cette distinction et de veiller \u00e0 ce que les budgets soient correctement provisionn\u00e9s.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2680\" data-end=\"2730\"><strong data-start=\"2680\" data-end=\"2730\">Quels sont les risques en cas de non-respect ?<\/strong><\/p>\n<p class=\"\" data-start=\"2732\" data-end=\"2940\">Ne pas organiser la formation obligatoire du CSE constitue une <strong data-start=\"2795\" data-end=\"2834\">entrave au fonctionnement du comit\u00e9<\/strong>, infraction p\u00e9nalement sanctionn\u00e9e par l\u2019article <strong data-start=\"2884\" data-end=\"2914\">L2317-1 du Code du travail<\/strong>. L\u2019employeur s\u2019expose \u00e0 :<\/p>\n<ul data-start=\"2942\" data-end=\"3327\">\n<li class=\"\" data-start=\"2942\" data-end=\"2997\">\n<p class=\"\" data-start=\"2944\" data-end=\"2997\">Une <strong data-start=\"2948\" data-end=\"2965\">amende p\u00e9nale<\/strong> pouvant aller jusqu\u2019\u00e0 7 500 \u20ac<\/p>\n<\/li>\n<li class=\"\" data-start=\"2998\" data-end=\"3082\">\n<p class=\"\" data-start=\"3000\" data-end=\"3082\">Une <strong data-start=\"3004\" data-end=\"3035\">demande judiciaire des \u00e9lus<\/strong> pour obtenir la formation \u00e0 titre r\u00e9troactif<\/p>\n<\/li>\n<li class=\"\" data-start=\"3083\" data-end=\"3184\">\n<p class=\"\" data-start=\"3085\" data-end=\"3184\">Des tensions sociales et blocages dans les \u00e9changes entre direction et repr\u00e9sentants du personnel<\/p>\n<\/li>\n<li class=\"\" data-start=\"3185\" data-end=\"3327\">\n<p class=\"\" data-start=\"3187\" data-end=\"3327\">Un affaiblissement des garanties de pr\u00e9vention en mati\u00e8re de sant\u00e9 et s\u00e9curit\u00e9, avec une possible mise en cause en cas d\u2019accident du travail<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3329\" data-end=\"3382\"><strong data-start=\"3329\" data-end=\"3382\">Cons\u00e9quences pratiques pour les employeurs de PME<\/strong><\/p>\n<p class=\"\" data-start=\"3384\" data-end=\"3698\">Dans les entreprises de 10 \u00e0 200 salari\u00e9s, o\u00f9 les ressources internes sont souvent limit\u00e9es, l\u2019oubli ou la mauvaise organisation de ces formations peut avoir des cons\u00e9quences lourdes.
