Pourtant, <strong data-start=\"222\" data-end=\"277\">sa mauvaise r\u00e9daction ou son application hasardeuse<\/strong> peut exposer l\u2019employeur \u00e0 un contentieux co\u00fbteux.<\/p><p class=\"\" data-start=\"332\" data-end=\"612\">La jurisprudence sociale est constante : la r\u00e9mun\u00e9ration variable doit \u00eatre <strong data-start=\"408\" data-end=\"471\">encadr\u00e9e par des crit\u00e8res objectifs, pr\u00e9cis et transparents<\/strong>. Elle constitue un <strong data-start=\"491\" data-end=\"524\">\u00e9l\u00e9ment du contrat de travail<\/strong> lorsqu\u2019elle est pr\u00e9vue contractuellement, ce qui implique un r\u00e9gime juridique strict.<\/p><h3 class=\"\" data-start=\"619\" data-end=\"672\">Encadrement juridique de la r\u00e9mun\u00e9ration variable<\/h3><p class=\"\" data-start=\"674\" data-end=\"867\">La r\u00e9mun\u00e9ration variable n\u2019est pas une simple facult\u00e9 pour l\u2019employeur. D\u00e8s lors qu\u2019elle est convenue contractuellement ou r\u00e9sulte d\u2019un usage constant, elle devient <strong data-start=\"839\" data-end=\"864\">opposable et exigible<\/strong>.<\/p><p class=\"\" data-start=\"869\" data-end=\"1017\">Le Code du travail n\u2019encadre pas directement la prime de mani\u00e8re autonome, mais les principes de droit commun du contrat de travail s\u2019appliquent :<\/p><ul data-start=\"1018\" data-end=\"1251\"><li class=\"\" data-start=\"1018\" data-end=\"1094\"><p class=\"\" data-start=\"1020\" data-end=\"1094\"><strong data-start=\"1020\" data-end=\"1091\">L\u2019employeur ne peut modifier unilat\u00e9ralement un \u00e9l\u00e9ment contractuel<\/strong>,<\/p><\/li><li class=\"\" data-start=\"1095\" data-end=\"1169\"><p class=\"\" data-start=\"1097\" data-end=\"1169\"><strong data-start=\"1097\" data-end=\"1166\">Les objectifs doivent \u00eatre fix\u00e9s de mani\u00e8re claire et atteignable<\/strong>,<\/p><\/li><li class=\"\" data-start=\"1170\" data-end=\"1251\"><p class=\"\" data-start=\"1172\" data-end=\"1251\"><strong data-start=\"1172\" data-end=\"1250\">Le versement d\u2019une prime ne peut \u00eatre conditionn\u00e9 par des crit\u00e8res ambigus<\/strong>.<\/p><\/li><\/ul><h3 class=\"\" data-start=\"1258\" data-end=\"1295\">Trois erreurs fr\u00e9quentes \u00e0 \u00e9viter<\/h3><p class=\"\" data-start=\"1297\" data-end=\"1344\"><strong data-start=\"1297\" data-end=\"1344\">1. Absence de crit\u00e8res clairs d\u2019attribution<\/strong><\/p><p class=\"\" data-start=\"1346\" data-end=\"1647\">Une prime doit reposer sur des <strong data-start=\"1377\" data-end=\"1401\">objectifs mesurables<\/strong> : chiffre d\u2019affaires, nombre de contrats sign\u00e9s, r\u00e9sultats individuels\u2026<br data-start=\"1473\" data-end=\"1476\" \/>S\u2019ils ne sont pas fix\u00e9s, <strong data-start=\"1501\" data-end=\"1559\">le salari\u00e9 pourrait r\u00e9clamer la prime syst\u00e9matiquement<\/strong>, m\u00eame sans atteindre de performance, au motif d\u2019un usage constant ou d\u2019un droit acquis.<\/p><p class=\"\" data-start=\"1649\" data-end=\"1695\"><strong data-start=\"1649\" data-end=\"1695\">2. Modification unilat\u00e9rale des conditions<\/strong><\/p><p class=\"\" data-start=\"1697\" data-end=\"2008\">D\u00e8s lors qu\u2019une prime figure dans le contrat, <strong data-start=\"1743\" data-end=\"1795\">toute modification n\u00e9cessite l\u2019accord du salari\u00e9<\/strong>.<br data-start=\"1796\" data-end=\"1799\" \/>Une suppression ou une baisse des montants ou des objectifs sans son consentement peut constituer une <strong data-start=\"1901\" data-end=\"1940\">modification unilat\u00e9rale du contrat<\/strong>, susceptible d\u2019\u00eatre requalifi\u00e9e en manquement grave de l\u2019employeur.<\/p><p class=\"\" data-start=\"2010\" data-end=\"2064\"><strong data-start=\"2010\" data-end=\"2064\">3.
