Mais que faire lorsqu\u2019un salari\u00e9 pr\u00e9sente des difficult\u00e9s relationnelles r\u00e9currentes avec ses coll\u00e8gues ? L\u2019employeur peut-il s\u2019appuyer sur ces \u00e9l\u00e9ments pour proc\u00e9der \u00e0 un licenciement ? Une r\u00e9cente d\u00e9cision de la Cour de cassation vient rappeler un principe fondamental en mati\u00e8re de licenciement disciplinaire.<\/p>\n<h2 class=\"\" data-start=\"609\" data-end=\"670\">Difficult\u00e9s relationnelles au travail : le cadre juridique<\/h2>\n<p class=\"\" data-start=\"672\" data-end=\"1006\">Le licenciement d\u2019un salari\u00e9 repose obligatoirement sur une cause r\u00e9elle et s\u00e9rieuse. Celle-ci peut \u00eatre <strong data-start=\"777\" data-end=\"794\">disciplinaire<\/strong> (faute du salari\u00e9) ou <strong data-start=\"817\" data-end=\"838\">non disciplinaire<\/strong> (insuffisance professionnelle, trouble objectif, etc.). La qualification du motif est essentielle, car elle d\u00e9termine la proc\u00e9dure applicable et les droits du salari\u00e9.<\/p>\n<p class=\"\" data-start=\"1008\" data-end=\"1285\">Lorsqu\u2019un employeur engage une proc\u00e9dure disciplinaire, il doit d\u00e9montrer une faute clairement identifiable, li\u00e9e \u00e0 un manquement aux obligations contractuelles ou au r\u00e8glement int\u00e9rieur. \u00c0 d\u00e9faut, le licenciement peut \u00eatre requalifi\u00e9, voire jug\u00e9 sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<h2 class=\"\" data-start=\"1287\" data-end=\"1358\">Ce que dit la jurisprudence : Cass. Soc., 12 juin 2024, n\u00b0 22-12.416<\/h2>\n<p class=\"\" data-start=\"1360\" data-end=\"1598\">Dans l\u2019affaire examin\u00e9e le 12 juin 2024, un salari\u00e9 \u2013 responsable de la validation interne \u2013 \u00e9tait licenci\u00e9 pour cause r\u00e9elle et s\u00e9rieuse en raison de m\u00e9sententes persistantes avec ses coll\u00e8gues, provoquant un climat de tension permanent.<\/p>\n<p class=\"\" data-start=\"1600\" data-end=\"1746\">Le salari\u00e9 a contest\u00e9 la rupture de son contrat, arguant que le motif invoqu\u00e9 relevait du disciplinaire. La Cour de cassation lui donne raison :<\/p>\n<blockquote data-start=\"1747\" data-end=\"1856\">\n<p class=\"\" data-start=\"1749\" data-end=\"1856\">\u00ab Les difficult\u00e9s relationnelles, aussi r\u00e9elles soient-elles, ne constituent pas une faute disciplinaire. \u00bb<\/p>\n<\/blockquote>\n<p class=\"\" data-start=\"1858\" data-end=\"2059\">Elle pr\u00e9cise que <strong data-start=\"1875\" data-end=\"1962\">l\u2019employeur ne peut fonder un licenciement disciplinaire sur de simples m\u00e9sententes<\/strong>. En l\u2019esp\u00e8ce, en l\u2019absence de faits fautifs caract\u00e9ris\u00e9s, le motif disciplinaire \u00e9tait inadapt\u00e9.<\/p>\n<h2 class=\"\" data-start=\"2061\" data-end=\"2106\">Cons\u00e9quences pratiques pour les employeurs<\/h2>\n<p class=\"\" data-start=\"2108\" data-end=\"2352\">Cette d\u00e9cision illustre l&#8217;importance de bien qualifier le motif de licenciement. Une <strong data-start=\"2193\" data-end=\"2220\">erreur de qualification<\/strong> peut entra\u00eener la requalification du licenciement et exposer l\u2019entreprise \u00e0 des <strong data-start=\"2301\" data-end=\"2351\">dommages-int\u00e9r\u00eats pour licenciement injustifi\u00e9<\/strong>.<\/p>\n<p class=\"\" data-start=\"2354\" data-end=\"2456\">Ainsi, si des tensions relationnelles affectent le bon fonctionnement d\u2019une \u00e9quipe, l\u2019employeur doit :<\/p>\n<ul data-start=\"2458\" data-end=\"2749\">\n<li class=\"\" data-start=\"2458\" data-end=\"2555\">\n<p class=\"\" data-start=\"2460\" data-end=\"2555\">documenter objectivement les difficult\u00e9s (entretiens, t\u00e9moignages, impacts sur l\u2019organisation),<\/p>\n<\/li>\n<li class=\"\" data-start=\"2556\" data-end=\"2642\">\n<p class=\"\" data-start=\"2558\" data-end=\"2642\">envisager d\u2019abord des solutions alternatives (m\u00e9diation, recadrage, r\u00e9organisation),<\/p>\n<\/li>\n<li class=\"\" data-start=\"2643\" data-end=\"2749\">\n<p class=\"\" data-start=\"2645\" data-end=\"2749\">et, en cas de rupture du contrat, <strong data-start=\"2679\" data-end=\"2716\">\u00e9viter la proc\u00e9dure disciplinaire<\/strong>, sauf comportement fautif av\u00e9r\u00e9.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"\" data-start=\"2751\" data-end=\"2776\">Le conseil de l\u2019avocat<\/h2>\n<p>Avant d\u2019engager toute proc\u00e9dure de licenciement pour m\u00e9sentente ou difficult\u00e9 relationnelle, <strong data-start=\"2871\" data-end=\"2915\">faites analyser pr\u00e9cis\u00e9ment la situation<\/strong>. Un accompagnement juridique vous permettra de choisir la strat\u00e9gie la plus adapt\u00e9e :<\/p>\n<ol>\n<li data-start=\"2778\" data-end=\"3190\">\u00a0licenciement pour insuffisance professionnelle,<\/li>\n<li data-start=\"2778\" data-end=\"3190\">trouble objectif au fonctionnement du service,<\/li>\n<li data-start=\"2778\" data-end=\"3190\">ou en dernier recours, licenciement pour faute si celle-ci est caract\u00e9ris\u00e9e.<\/li>\n<\/ol>\n<p class=\"\" data-start=\"3192\" data-end=\"3337\">Enfin, pensez \u00e0 former vos managers \u00e0 la gestion des conflits internes, afin de pr\u00e9venir les situations \u00e0 risque et \u00e9viter l\u2019escalade judiciaire.<\/p>\n<h2 class=\"\" data-start=\"3339\" data-end=\"3363\">R\u00e9f\u00e9rences juridiques<\/h2>\n<p class=\"\" data-start=\"3365\" data-end=\"3480\">Cass.
