Pourtant, cette pratique, connue sous le nom de d\u00e9bauchage, est encadr\u00e9e par le droit et peut s\u2019av\u00e9rer risqu\u00e9e pour l\u2019employeur recruteur. Clause de non-concurrence, d\u00e9tournement de client\u00e8le, usage d\u2019informations confidentielles : les risques sont multiples. Une r\u00e9cente d\u00e9cision de la Cour de cassation vient rappeler que l\u2019imprudence peut co\u00fbter cher.<\/p>\n<p class=\"\" data-start=\"637\" data-end=\"957\"><strong data-start=\"637\" data-end=\"695\">Le cadre juridique applicable au d\u00e9bauchage de salari\u00e9<\/strong><br data-start=\"695\" data-end=\"698\" \/>En droit du travail, le principe de libert\u00e9 de travailler permet \u00e0 tout salari\u00e9 de changer d\u2019employeur. Toutefois, cette libert\u00e9 peut \u00eatre limit\u00e9e par des clauses contractuelles, notamment la clause de non-concurrence.<br data-start=\"916\" data-end=\"919\" \/>Pour \u00eatre valable, cette clause doit :<\/p>\n<ul data-start=\"959\" data-end=\"1129\">\n<li class=\"\" data-start=\"959\" data-end=\"1034\">\n<p class=\"\" data-start=\"961\" data-end=\"1034\">\u00eatre indispensable \u00e0 la protection des int\u00e9r\u00eats l\u00e9gitimes de l\u2019entreprise<\/p>\n<\/li>\n<li class=\"\" data-start=\"1035\" data-end=\"1075\">\n<p class=\"\" data-start=\"1037\" data-end=\"1075\">\u00eatre limit\u00e9e dans le temps et l\u2019espace<\/p>\n<\/li>\n<li class=\"\" data-start=\"1076\" data-end=\"1129\">\n<p class=\"\" data-start=\"1078\" data-end=\"1129\">pr\u00e9voir une contrepartie financi\u00e8re pour le salari\u00e9<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1131\" data-end=\"1353\">Lorsque cette clause est respect\u00e9e, le salari\u00e9 ne peut rejoindre une entreprise concurrente pendant la dur\u00e9e pr\u00e9vue. Si l\u2019employeur recruteur a connaissance de cette clause, il engage sa responsabilit\u00e9 en cas de violation.<\/p>\n<p class=\"\" data-start=\"1355\" data-end=\"1619\">Par ailleurs, m\u00eame en l\u2019absence de clause de non-concurrence, l\u2019employeur peut \u00eatre sanctionn\u00e9 en cas de d\u00e9bauchage accompagn\u00e9 de pratiques d\u00e9loyales : d\u00e9tournement de client\u00e8le, incitation \u00e0 rompre un contrat, ou encore utilisation d\u2019informations confidentielles.<\/p>\n<p class=\"\" data-start=\"1621\" data-end=\"2278\"><strong data-start=\"1621\" data-end=\"1707\">L\u2019analyse d\u2019un cas concret : la d\u00e9cision de la Cour de cassation du 5 juillet 2023<\/strong><br data-start=\"1707\" data-end=\"1710\" \/>Dans l\u2019arr\u00eat <strong data-start=\"1723\" data-end=\"1767\">Cass. Com., 5 juillet 2023, n\u00b0 22-15.678<\/strong>, une entreprise a \u00e9t\u00e9 condamn\u00e9e pour avoir recrut\u00e9 un salari\u00e9 en connaissance de sa clause de non-concurrence.<br data-start=\"1878\" data-end=\"1881\" \/>Les juges ont estim\u00e9 que le nouvel employeur ne pouvait ignorer l\u2019existence de cette clause, et qu\u2019il avait agi d\u00e9lib\u00e9r\u00e9ment en violation de celle-ci. En cons\u00e9quence, il a \u00e9t\u00e9 reconnu coupable de concurrence d\u00e9loyale.<br data-start=\"2098\" data-end=\"2101\" \/>Ce type de comportement est analys\u00e9 comme une faute au sens de l\u2019article 1240 du Code civil (anciennement article 1382), engageant la responsabilit\u00e9 d\u00e9lictuelle de l\u2019entreprise.<\/p>\n<p class=\"\" data-start=\"2280\" data-end=\"2415\"><strong data-start=\"2280\" data-end=\"2326\">Cons\u00e9quences pratiques pour les employeurs<\/strong><br data-start=\"2326\" data-end=\"2329\" \/>Le d\u00e9bauchage mal ma\u00eetris\u00e9 peut entra\u00eener des cons\u00e9quences lourdes pour l\u2019entreprise :<\/p>\n<ul data-start=\"2417\" data-end=\"2702\">\n<li class=\"\" data-start=\"2417\" data-end=\"2519\">\n<p class=\"\" data-start=\"2419\" data-end=\"2519\"><strong data-start=\"2419\" data-end=\"2461\">Condamnation pour concurrence d\u00e9loyale<\/strong>, avec versement de dommages-int\u00e9r\u00eats \u00e0 l\u2019ancien employeur<\/p>\n<\/li>\n<li class=\"\" data-start=\"2520\" data-end=\"2609\">\n<p class=\"\" data-start=\"2522\" data-end=\"2609\"><strong data-start=\"2522\" data-end=\"2544\">Atteinte \u00e0 l\u2019image<\/strong> et r\u00e9putation entach\u00e9e aupr\u00e8s des partenaires ou dans le secteur<\/p>\n<\/li>\n<li class=\"\" data-start=\"2610\" data-end=\"2702\">\n<p class=\"\" data-start=\"2612\" data-end=\"2702\"><strong data-start=\"2612\" data-end=\"2633\">Action en justice<\/strong> potentielle contre le salari\u00e9 d\u00e9bauch\u00e9, cr\u00e9ant des tensions internes<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2704\" data-end=\"2833\">Il est donc imp\u00e9ratif de s\u00e9curiser le processus de recrutement, en particulier lorsqu\u2019un salari\u00e9 provient d\u2019un concurrent direct.<\/p>\n<p class=\"\" data-start=\"2835\" data-end=\"2933\"><strong data-start=\"2835\" data-end=\"2858\">Conseil de l\u2019avocat<\/strong><br data-start=\"2858\" data-end=\"2861\" \/>Avant de recruter un salari\u00e9 issu d\u2019un concurrent, il est essentiel de :<\/p>\n<ul data-start=\"2935\" data-end=\"3478\">\n<li class=\"\" data-start=\"2935\" data-end=\"3031\">\n<p class=\"\" data-start=\"2937\" data-end=\"3031\"><strong data-start=\"2937\" data-end=\"2993\">V\u00e9rifier l\u2019existence d\u2019une clause de non-concurrence<\/strong> dans son contrat de travail pr\u00e9c\u00e9dent<\/p>\n<\/li>\n<li class=\"\" data-start=\"3032\" data-end=\"3119\">\n<p class=\"\" data-start=\"3034\" data-end=\"3119\">Demander au salari\u00e9 de <strong data-start=\"3057\" data-end=\"3119\">fournir une attestation de mainlev\u00e9e ou de lev\u00e9e de clause<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"3120\" data-end=\"3265\">\n<p class=\"\" data-start=\"3122\" data-end=\"3265\">Int\u00e9grer une <strong data-start=\"3135\" data-end=\"3157\">clause d\u00e9clarative<\/strong> dans le nouveau contrat, par laquelle le salari\u00e9 confirme ne pas \u00eatre li\u00e9 par une clause de non-concurrence<\/p>\n<\/li>\n<li class=\"\" data-start=\"3266\" data-end=\"3371\">\n<p class=\"\" data-start=\"3268\" data-end=\"3371\">Ne jamais inciter un salari\u00e9 \u00e0 rompre un contrat ou \u00e0 transf\u00e9rer des donn\u00e9es de son pr\u00e9c\u00e9dent employeur<\/p>\n<\/li>\n<li class=\"\" data-start=\"3372\" data-end=\"3478\">\n<p class=\"\" data-start=\"3374\" data-end=\"3478\">Se faire accompagner par un avocat en droit du travail pour auditer la situation en amont du recrutement<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3480\" data-end=\"3507\"><strong data-start=\"3480\" data-end=\"3505\">R\u00e9f\u00e9rences juridiques<\/strong><\/p>\n<ul data-start=\"3508\" data-end=\"3712\">\n<li class=\"\" data-start=\"3508\" data-end=\"3556\">\n<p class=\"\" data-start=\"3510\" data-end=\"3556\"><strong data-start=\"3510\" data-end=\"3554\">Cass.
