S\u2019il offre souplesse et autonomie, il expose aussi l\u2019employeur \u00e0 des risques juridiques lorsqu\u2019il est mal encadr\u00e9. Une politique de t\u00e9l\u00e9travail mal d\u00e9finie ou non conforme au droit du travail peut entra\u00eener des contentieux, des r\u00e9clamations de salari\u00e9s, voire des sanctions de l\u2019inspection du travail. Il est donc essentiel d\u2019adopter une approche rigoureuse pour s\u00e9curiser cette organisation du travail.<\/p>\n<p class=\"\" data-start=\"618\" data-end=\"1486\"><strong data-start=\"618\" data-end=\"687\">Le cadre juridique du t\u00e9l\u00e9travail : ce que dit le Code du travail<\/strong><br data-start=\"687\" data-end=\"690\" \/>Le t\u00e9l\u00e9travail est d\u00e9fini \u00e0 l\u2019article L1222-9 du Code du travail comme &#8220;toute forme d&#8217;organisation du travail dans laquelle un travail qui aurait \u00e9galement pu \u00eatre r\u00e9alis\u00e9 dans les locaux de l&#8217;employeur est effectu\u00e9 par un salari\u00e9 hors de ces locaux de fa\u00e7on volontaire en utilisant les technologies de l&#8217;information et de la communication&#8221;.<br data-start=\"1031\" data-end=\"1034\" \/>Le principe fondateur est donc <strong data-start=\"1065\" data-end=\"1083\">le volontariat<\/strong> : l\u2019accord du salari\u00e9 est indispensable, sauf circonstances exceptionnelles (notamment pand\u00e9mie ou cas de force majeure, comme pr\u00e9cis\u00e9 \u00e0 l\u2019article L1222-11).<br data-start=\"1241\" data-end=\"1244\" \/>Le t\u00e9l\u00e9travail peut \u00eatre mis en place par un accord collectif ou, \u00e0 d\u00e9faut, par une charte \u00e9labor\u00e9e apr\u00e8s avis du CSE. En l&#8217;absence de ces documents, un <strong data-start=\"1397\" data-end=\"1430\">avenant au contrat de travail<\/strong> est recommand\u00e9 pour formaliser les modalit\u00e9s convenues.<\/p>\n<p class=\"\" data-start=\"1488\" data-end=\"2340\"><strong data-start=\"1488\" data-end=\"1564\">Jurisprudence : les juges rappellent l\u2019importance d\u2019un encadrement clair<\/strong><br data-start=\"1564\" data-end=\"1567\" \/>Plusieurs d\u00e9cisions r\u00e9centes ont confirm\u00e9 les risques li\u00e9s \u00e0 un t\u00e9l\u00e9travail mal encadr\u00e9.<br data-start=\"1655\" data-end=\"1658\" \/>\ud83d\udc49 <strong data-start=\"1661\" data-end=\"1699\">Cour d\u2019appel de Paris, 9 mars 2022<\/strong> : un salari\u00e9 obtient la reconnaissance de frais professionnels non rembours\u00e9s li\u00e9s \u00e0 son activit\u00e9 en t\u00e9l\u00e9travail (factures d&#8217;\u00e9lectricit\u00e9 et abonnement internet), l\u2019employeur n\u2019ayant pr\u00e9vu aucune prise en charge dans un document \u00e9crit.<br data-start=\"1934\" data-end=\"1937\" \/>\ud83d\udc49 <strong data-start=\"1940\" data-end=\"1992\">Cour de cassation, 17 f\u00e9vrier 2021, n\u00b0 19-13.883<\/strong> : l\u2019imposition unilat\u00e9rale du t\u00e9l\u00e9travail sans accord pr\u00e9alable du salari\u00e9 est jug\u00e9e illicite en dehors de circonstances exceptionnelles.<br data-start=\"2130\" data-end=\"2133\" \/>\ud83d\udc49 Autre exemple, dans une d\u00e9cision du <strong data-start=\"2172\" data-end=\"2214\">tribunal judiciaire de Nanterre (2021)<\/strong>, une entreprise a \u00e9t\u00e9 rappel\u00e9e \u00e0 l\u2019ordre pour ne pas avoir respect\u00e9 le droit \u00e0 la d\u00e9connexion de ses salari\u00e9s en t\u00e9l\u00e9travail.<\/p>\n<p class=\"\" data-start=\"2342\" data-end=\"2475\"><strong data-start=\"2342\" data-end=\"2392\">Les cons\u00e9quences pratiques pour les employeurs<\/strong><br data-start=\"2392\" data-end=\"2395\" \/>Un
