Mais est-ce juridiquement fond\u00e9 ? La Cour de cassation vient de rappeler les contours stricts de cette sanction extr\u00eame.<\/p>\n<h2 class=\"\" data-start=\"504\" data-end=\"562\">Perte de permis : une situation fr\u00e9quente mais encadr\u00e9e<\/h2>\n<p class=\"\" data-start=\"564\" data-end=\"950\">Les cadres itin\u00e9rants \u2013 consultants, technico-commerciaux, ing\u00e9nieurs d\u2019affaires \u2013 sont nombreux \u00e0 passer une part importante de leur temps sur la route. Pour ces salari\u00e9s, la d\u00e9tention d\u2019un permis de conduire valide semble aller de soi. Pourtant, la suspension, le retrait ou l\u2019annulation du permis ne permettent pas toujours un licenciement imm\u00e9diat, et encore moins pour faute grave.<\/p>\n<p class=\"\" data-start=\"952\" data-end=\"1053\">Le 22 janvier 2025, la Cour de cassation a apport\u00e9 un \u00e9clairage important dans un arr\u00eat tr\u00e8s attendu.<\/p>\n<h2 class=\"\" data-start=\"1055\" data-end=\"1111\">Ce que dit le droit : pas de licenciement automatique<\/h2>\n<p class=\"\" data-start=\"1113\" data-end=\"1384\">Dans son arr\u00eat du 22 janvier 2025 (Cass. soc., n\u00b0 23-20.792), la Cour de cassation rappelle qu\u2019un licenciement pour faute grave suppose une violation suffisamment caract\u00e9ris\u00e9e des obligations du salari\u00e9, rendant impossible son maintien dans l\u2019entreprise, m\u00eame provisoire.<\/p>\n<p class=\"\" data-start=\"1386\" data-end=\"1599\">Or, la perte du permis n&#8217;est pas automatiquement fautive. Un exc\u00e8s de vitesse isol\u00e9, m\u00eame s\u2019il entra\u00eene une suspension temporaire du permis, ne suffit pas en lui-m\u00eame \u00e0 justifier un licenciement pour faute grave.<\/p>\n<p class=\"\" data-start=\"1601\" data-end=\"1639\">L&#8217;employeur doit prouver deux choses :<\/p>\n<ol data-start=\"1640\" data-end=\"1831\">\n<li class=\"\" data-start=\"1640\" data-end=\"1714\">\n<p class=\"\" data-start=\"1643\" data-end=\"1714\">Que l&#8217;absence de permis emp\u00eache concr\u00e8tement l&#8217;ex\u00e9cution des missions ;<\/p>\n<\/li>\n<li class=\"\" data-start=\"1715\" data-end=\"1831\">\n<p class=\"\" data-start=\"1718\" data-end=\"1831\">Qu&#8217;aucune solution alternative n\u2019est envisageable (transports en commun, co-voiturage, r\u00e9affectation temporaire).<\/p>\n<\/li>\n<\/ol>\n<h2 class=\"\" data-start=\"1833\" data-end=\"1897\">Ce que dit la jurisprudence : une appr\u00e9ciation au cas par cas<\/h2>\n<p class=\"\" data-start=\"1899\" data-end=\"2230\">Dans l\u2019affaire jug\u00e9e en janvier 2025, un cadre itin\u00e9rant avait perdu son permis apr\u00e8s un exc\u00e8s de vitesse. L\u2019employeur avait imm\u00e9diatement engag\u00e9 une proc\u00e9dure de licenciement pour faute grave. Pourtant, le salari\u00e9 avait propos\u00e9 des solutions transitoires (co-voiturage avec un coll\u00e8gue, t\u00e9l\u00e9travail partiel, missions s\u00e9dentaires).<\/p>\n<p class=\"\" data-start=\"2232\" data-end=\"2520\">La Cour a estim\u00e9 que l\u2019entreprise ne pouvait pas invoquer la faute grave sans avoir \u00e9tudi\u00e9 ces alternatives. Elle a aussi rappel\u00e9 que l\u2019entreprise a une obligation de pr\u00e9vention, notamment en mati\u00e8re de s\u00e9curit\u00e9 routi\u00e8re, et qu\u2019elle ne peut se contenter de sanctionner sans agir en amont.<\/p>\n<h2 class=\"\" data-start=\"2522\" data-end=\"2571\">Les cons\u00e9quences pratiques pour les employeurs<\/h2>\n<p class=\"\" data-start=\"2573\" data-end=\"2715\">Ce rappel \u00e0 l\u2019ordre de la Cour de cassation invite les employeurs \u00e0 faire preuve de prudence et \u00e0 analyser chaque situation individuellement :<\/p>\n<ul data-start=\"2717\" data-end=\"3057\">\n<li class=\"\" data-start=\"2717\" data-end=\"2842\">\n<p class=\"\" data-start=\"2719\" data-end=\"2842\">Un salari\u00e9 priv\u00e9 de permis ne peut pas \u00eatre licenci\u00e9 pour faute grave sans d\u00e9monstration d\u2019une impossibilit\u00e9 d\u2019am\u00e9nagement.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2843\" data-end=\"2957\">\n<p class=\"\" data-start=\"2845\" data-end=\"2957\">L\u2019absence de permis peut justifier un licenciement pour cause r\u00e9elle et s\u00e9rieuse, mais pas n\u00e9cessairement grave.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2958\" data-end=\"3057\">\n<p class=\"\" data-start=\"2960\" data-end=\"3057\">L\u2019entreprise doit montrer qu\u2019elle a tent\u00e9 d\u2019identifier des alternatives ou solutions provisoires.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"\" data-start=\"3059\" data-end=\"3084\">Le conseil de l\u2019avocat<\/h2>\n<p class=\"\" data-start=\"3086\" data-end=\"3187\">Avant d\u2019engager une proc\u00e9dure disciplinaire en cas de perte de permis, v\u00e9rifiez les points suivants :<\/p>\n<ul data-start=\"3189\" data-end=\"3444\">\n<li class=\"\" data-start=\"3189\" data-end=\"3265\">\n<p class=\"\" data-start=\"3191\" data-end=\"3265\">Le permis est-il express\u00e9ment exig\u00e9 dans le contrat ou la fiche de poste ?<\/p>\n<\/li>\n<li class=\"\" data-start=\"3266\" data-end=\"3363\">\n<p class=\"\" data-start=\"3268\" data-end=\"3363\">Existe-t-il des moyens d\u2019am\u00e9nagement provisoire (chauffeur, transports collectifs, coworking) ?<\/p>\n<\/li>\n<li class=\"\" data-start=\"3364\" data-end=\"3444\">\n<p class=\"\" data-start=\"3366\" data-end=\"3444\">Une politique de sensibilisation aux risques routiers est-elle mise en place ?<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3446\" data-end=\"3607\">Si la perte du permis est li\u00e9e \u00e0 un comportement fautif, l\u2019analyse sera diff\u00e9rente selon que ce comportement ait \u00e9t\u00e9 isol\u00e9, r\u00e9p\u00e9t\u00e9 ou d\u2019une particuli\u00e8re gravit\u00e9.<\/p>\n<p class=\"\" data-start=\"3609\" data-end=\"3777\">Enfin, n\u2019oubliez pas que la faute grave prive le salari\u00e9 de pr\u00e9avis et d\u2019indemnit\u00e9s : les juridictions sont donc particuli\u00e8rement exigeantes quant \u00e0 sa caract\u00e9risation.<\/p>\n<h2 class=\"\" data-start=\"3779\" data-end=\"3803\">R\u00e9f\u00e9rences juridiques<\/h2>\n<p class=\"\" data-start=\"3804\" data-end=\"3960\">Cour de cassation, chambre sociale, 22 janvier 2025, n\u00b0 23-20.792<br data-start=\"3869\" data-end=\"3872\" \/>Articles L1232-1 et L1234-1 du Code du travail (proc\u00e9dure de licenciement et indemnit\u00e9s)<\/p>\n<p data-start=\"3804\" data-end=\"3960\">Besoin de s\u00e9curiser vos pratiques RH ?
