Mais que se passe-t-il lorsqu\u2019un salari\u00e9, m\u00eame exemplaire, manque \u00e0 cette obligation essentielle\u202f? La question se pose avec acuit\u00e9 lorsqu\u2019un collaborateur divulgue des donn\u00e9es couvertes par le secret professionnel. Faute grave ou simple manquement ? Une d\u00e9cision r\u00e9cente de la Cour de cassation vient \u00e9clairer les employeurs sur l\u2019importance absolue de la confidentialit\u00e9 au sein de l\u2019entreprise.<\/p>\n<p class=\"\" data-start=\"692\" data-end=\"1147\"><strong data-start=\"692\" data-end=\"727\">Le cadre juridique applicable :<\/strong><br data-start=\"727\" data-end=\"730\" \/>En droit du travail, la faute grave est celle qui rend impossible le maintien du salari\u00e9 dans l\u2019entreprise, y compris pendant la dur\u00e9e du pr\u00e9avis (Cass. Soc., 26 f\u00e9vr. 1991, n\u00b0 88-43.120). Le secret professionnel, quant \u00e0 lui, est une obligation l\u00e9gale dans certains secteurs comme la sant\u00e9, la finance ou les administrations publiques. Sa violation peut entra\u00eener des cons\u00e9quences disciplinaires, civiles et p\u00e9nales.<\/p>\n<p class=\"\" data-start=\"1149\" data-end=\"1413\">L\u2019article L1222-1 du Code du travail impose au salari\u00e9 d\u2019ex\u00e9cuter son contrat de bonne foi, ce qui inclut le respect de la confidentialit\u00e9. Cette obligation peut aussi \u00eatre renforc\u00e9e par des clauses sp\u00e9cifiques dans le contrat de travail ou le r\u00e8glement int\u00e9rieur.<\/p>\n<p class=\"\" data-start=\"1415\" data-end=\"1750\"><strong data-start=\"1415\" data-end=\"1448\">Analyse de la jurisprudence :<\/strong><br data-start=\"1448\" data-end=\"1451\" \/>Dans cette affaire (Cass. Soc. 11 septembre 2024, n\u00b0 22-13.531), un salari\u00e9 de la CPAM a transmis \u00e0 des tiers des informations confidentielles concernant un ministre en exercice. L\u2019employeur a prononc\u00e9 un licenciement pour faute grave, consid\u00e9rant la gravit\u00e9 de la violation du secret professionnel.<\/p>\n<p class=\"\" data-start=\"1752\" data-end=\"1982\">La cour d\u2019appel a pourtant annul\u00e9 ce licenciement, en mettant en avant la longue anciennet\u00e9 du salari\u00e9 (36 ans) et son absence d\u2019ant\u00e9c\u00e9dents disciplinaires. Pour elle, ces \u00e9l\u00e9ments militaient en faveur d\u2019une sanction moins s\u00e9v\u00e8re.<\/p>\n<p class=\"\" data-start=\"1984\" data-end=\"2348\">Mais la Cour de cassation casse cette d\u00e9cision : peu importe l\u2019anciennet\u00e9 ou le pass\u00e9 irr\u00e9prochable du salari\u00e9, la nature des faits \u2013 la divulgation d\u2019informations confidentielles \u2013 justifie \u00e0 elle seule une faute grave. Le respect du secret professionnel constitue une exigence incontournable dont la violation entra\u00eene une rupture imm\u00e9diate du lien de confiance.<\/p>\n<p class=\"\" data-start=\"2350\" data-end=\"2600\"><strong data-start=\"2350\" data-end=\"2398\">Cons\u00e9quences pratiques pour les employeurs :<\/strong><br data-start=\"2398\" data-end=\"2401\" \/>Cette d\u00e9cision rappelle aux employeurs l\u2019importance de prot\u00e9ger les donn\u00e9es sensibles. Un manquement au devoir de confidentialit\u00e9 peut justifier un licenciement imm\u00e9diat, m\u00eame pour un salari\u00e9 mod\u00e8le.<\/p>\n<p class=\"\" data-start=\"2602\" data-end=\"2641\">Cela implique pour les entreprises de :<\/p>\n<ul data-start=\"2642\" data-end=\"2910\">\n<li class=\"\" data-start=\"2642\" data-end=\"2720\">\n<p class=\"\" data-start=\"2644\" data-end=\"2720\">sensibiliser leurs \u00e9quipes aux obligations de confidentialit\u00e9 d\u00e8s l\u2019embauche<\/p>\n<\/li>\n<li class=\"\" data-start=\"2721\" data-end=\"2814\">\n<p class=\"\" data-start=\"2723\" data-end=\"2814\">encadrer contractuellement cette exigence (clause de confidentialit\u00e9, charte informatique\u2026)<\/p>\n<\/li>\n<li class=\"\" data-start=\"2815\" data-end=\"2910\">\n<p class=\"\" data-start=\"2817\" data-end=\"2910\">adopter des proc\u00e9dures internes de contr\u00f4le et de tra\u00e7abilit\u00e9 des acc\u00e8s aux donn\u00e9es sensibles<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2912\" data-end=\"3003\"><strong data-start=\"2912\" data-end=\"2937\">Conseil de l\u2019avocat :<\/strong><br data-start=\"2937\" data-end=\"2940\" \/>Pour pr\u00e9venir ce type de situation, nous vous recommandons de :<\/p>\n<ol data-start=\"3004\" data-end=\"3457\">\n<li class=\"\" data-start=\"3004\" data-end=\"3167\">\n<p class=\"\" data-start=\"3007\" data-end=\"3167\"><strong data-start=\"3007\" data-end=\"3044\">Former r\u00e9guli\u00e8rement vos salari\u00e9s<\/strong> sur leurs obligations en mati\u00e8re de secret professionnel, notamment \u00e0 l\u2019occasion de l\u2019int\u00e9gration ou d\u2019\u00e9volutions de poste<\/p>\n<\/li>\n<li class=\"\" data-start=\"3168\" data-end=\"3270\">\n<p class=\"\" data-start=\"3171\" data-end=\"3270\"><strong data-start=\"3171\" data-end=\"3241\">Inscrire explicitement cette obligation dans le contrat de travail<\/strong> et\/ou le r\u00e8glement int\u00e9rieur<\/p>\n<\/li>\n<li class=\"\" data-start=\"3271\" data-end=\"3369\">\n<p class=\"\" data-start=\"3274\" data-end=\"3369\"><strong data-start=\"3274\" data-end=\"3313\">Documenter toute violation pr\u00e9sum\u00e9e<\/strong> afin de justifier juridiquement une \u00e9ventuelle sanction<\/p>\n<\/li>\n<li class=\"\" data-start=\"3370\" data-end=\"3457\">\n<p class=\"\" data-start=\"3373\" data-end=\"3457\"><strong data-start=\"3373\" data-end=\"3394\">R\u00e9agir sans d\u00e9lai<\/strong> en cas de faute, pour ne pas affaiblir la port\u00e9e disciplinaire<\/p>\n<\/li>\n<\/ol>\n<p class=\"\" data-start=\"3459\" data-end=\"3586\">En cas de doute, un accompagnement juridique est essentiel pour s\u00e9curiser la proc\u00e9dure et \u00e9valuer la qualification de la faute.<\/p>\n<p class=\"\" data-start=\"3588\" data-end=\"3709\"><strong data-start=\"3588\" data-end=\"3604\">R\u00e9f\u00e9rences :<\/strong><br data-start=\"3604\" data-end=\"3607\" \/>Cour de cassation, chambre sociale, 11 septembre 2024, n\u00b0 22-13.531<br data-start=\"3674\" data-end=\"3677\" \/>Code du travail, article L1222-1<\/p>\n<p data-start=\"3588\" data-end=\"3709\">Besoin de s\u00e9curiser vos pratiques RH ?
