La question est sensible et fr\u00e9quente dans les entreprises, notamment les PME o\u00f9 chaque absence peut rapidement d\u00e9sorganiser le fonctionnement interne. Si la protection du salari\u00e9 malade est un principe fort en droit du travail, elle conna\u00eet des limites. Un arr\u00eat de travail prolong\u00e9 ou r\u00e9p\u00e9t\u00e9 peut, dans certaines conditions strictes, justifier un licenciement. La r\u00e9cente d\u00e9cision de la Cour de cassation du 13 septembre 2023 apporte des pr\u00e9cisions importantes pour les employeurs.<\/p>\n<p class=\"\" data-start=\"686\" data-end=\"1358\"><strong data-start=\"686\" data-end=\"749\">Le cadre juridique du licenciement pendant un arr\u00eat maladie<\/strong><br data-start=\"749\" data-end=\"752\" \/>En principe, l\u2019\u00e9tat de sant\u00e9 d\u2019un salari\u00e9 ne peut, en tant que tel, constituer un motif de licenciement (article L1132-1 du Code du travail). Licencier un salari\u00e9 uniquement en raison de son arr\u00eat maladie est donc discriminatoire et entra\u00eene la nullit\u00e9 du licenciement.<br data-start=\"1021\" data-end=\"1024\" \/>Cependant, la jurisprudence admet une exception : un employeur peut licencier un salari\u00e9 absent pour maladie si cette absence cause une <strong data-start=\"1160\" data-end=\"1206\">d\u00e9sorganisation importante de l\u2019entreprise<\/strong> et n\u00e9cessite son <strong data-start=\"1224\" data-end=\"1250\">remplacement d\u00e9finitif<\/strong>. Cette position, constante depuis plusieurs ann\u00e9es, exige toutefois une d\u00e9monstration rigoureuse des faits.<\/p>\n<p class=\"\" data-start=\"1360\" data-end=\"1799\"><strong data-start=\"1360\" data-end=\"1432\">L\u2019analyse de l\u2019arr\u00eat du 13 septembre 2023 (Cass. soc., n\u00b0 21-11.432)<\/strong><br data-start=\"1432\" data-end=\"1435\" \/>Dans cette affaire, un employeur avait licenci\u00e9 un salari\u00e9 en arr\u00eat maladie prolong\u00e9, en invoquant une perturbation significative de l\u2019organisation de son entreprise. Le salari\u00e9 a contest\u00e9, estimant que son licenciement \u00e9tait fond\u00e9 uniquement sur son \u00e9tat de sant\u00e9.<br data-start=\"1700\" data-end=\"1703\" \/>La Cour de cassation a valid\u00e9 le licenciement, en rappelant les deux conditions essentielles :<\/p>\n<ol data-start=\"1800\" data-end=\"2270\">\n<li class=\"\" data-start=\"1800\" data-end=\"1993\">\n<p class=\"\" data-start=\"1803\" data-end=\"1993\">L\u2019absence du salari\u00e9 doit engendrer une v\u00e9ritable d\u00e9sorganisation, objectivement d\u00e9montrable (r\u00e9partition des t\u00e2ches perturb\u00e9e, surcharge pour les autres salari\u00e9s, perte de march\u00e9s, etc.).<\/p>\n<\/li>\n<li class=\"\" data-start=\"1994\" data-end=\"2270\">\n<p class=\"\" data-start=\"1997\" data-end=\"2270\">Le remplacement du salari\u00e9 doit \u00eatre <strong data-start=\"2034\" data-end=\"2047\">d\u00e9finitif<\/strong>, et non temporaire (embauche en CDI, contrat ferme et p\u00e9renne).<br data-start=\"2111\" data-end=\"2114\" \/>En l\u2019esp\u00e8ce, l\u2019employeur avait apport\u00e9 la preuve d\u2019une r\u00e9organisation contrainte et du recrutement d\u2019un rempla\u00e7ant en CDI, rendant le licenciement l\u00e9gitime.<\/p>\n<\/li>\n<\/ol>\n<p class=\"\" data-start=\"2272\" data-end=\"2477\"><strong data-start=\"2272\" data-end=\"2318\">Cons\u00e9quences pratiques pour les employeurs<\/strong><br data-start=\"2318\" data-end=\"2321\" \/>Cet arr\u00eat confirme que le licenciement d\u2019un salari\u00e9 malade reste possible, mais uniquement dans des circonstances bien pr\u00e9cises.<br data-start=\"2449\" data-end=\"2452\" \/>Les PME doivent ainsi :<\/p>\n<ul data-start=\"2478\" data-end=\"2854\">\n<li class=\"\" data-start=\"2478\" data-end=\"2558\">\n<p class=\"\" data-start=\"2480\" data-end=\"2558\">\u00c9valuer pr\u00e9cis\u00e9ment l\u2019impact de l\u2019absence sur l\u2019organisation de l\u2019entreprise<\/p>\n<\/li>\n<li class=\"\" data-start=\"2559\" data-end=\"2625\">\n<p class=\"\" data-start=\"2561\" data-end=\"2625\">Documenter toute d\u00e9marche de r\u00e9organisation ou surcharge subie<\/p>\n<\/li>\n<li class=\"\" data-start=\"2626\" data-end=\"2854\">\n<p class=\"\" data-start=\"2628\" data-end=\"2854\">Justifier le caract\u00e8re d\u00e9finitif du remplacement<br data-start=\"2676\" data-end=\"2679\" \/>Sans ces \u00e9l\u00e9ments, le licenciement pourra \u00eatre annul\u00e9 pour discrimination fond\u00e9e sur l\u2019\u00e9tat de sant\u00e9, avec \u00e0 la cl\u00e9 une r\u00e9int\u00e9gration possible ou une indemnisation importante.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2856\" data-end=\"3464\"><strong data-start=\"2856\" data-end=\"2879\">Conseil de l\u2019avocat<\/strong><br data-start=\"2879\" data-end=\"2882\" \/>Avant d\u2019envisager un licenciement pour absence prolong\u00e9e, il est essentiel d\u2019\u00e9tablir un <strong data-start=\"2970\" data-end=\"2988\">dossier solide<\/strong> : analyse de l\u2019activit\u00e9 impact\u00e9e, difficult\u00e9s rencontr\u00e9es, preuves concr\u00e8tes de d\u00e9sorganisation, justificatif du recrutement d\u00e9finitif.<br data-start=\"3124\" data-end=\"3127\" \/>Une consultation en amont avec un avocat vous permettra de s\u00e9curiser la proc\u00e9dure et d\u2019\u00e9viter tout risque de contentieux.<br data-start=\"3248\" data-end=\"3251\" \/>Attention \u00e9galement \u00e0 ne pas cumuler ce type de licenciement avec d\u2019autres \u00e9l\u00e9ments touchant \u00e0 l\u2019\u00e9tat de sant\u00e9 du salari\u00e9 (accident du travail, maladie professionnelle), qui b\u00e9n\u00e9ficient d\u2019une protection renforc\u00e9e.<\/p>\n<p class=\"\" data-start=\"3466\" data-end=\"3493\"><strong data-start=\"3466\" data-end=\"3491\">R\u00e9f\u00e9rences juridiques<\/strong><\/p>\n<p class=\"\" data-start=\"168\" data-end=\"607\">\u00a0<\/p>\n<ul data-start=\"3494\" data-end=\"3600\">\n<li class=\"\" data-start=\"3494\" data-end=\"3530\">\n<p class=\"\" data-start=\"3496\" data-end=\"3530\">Code du travail, article L1132-1<\/p>\n<\/li>\n<li class=\"\" data-start=\"3531\" data-end=\"3600\">\n<p class=\"\" data-start=\"3533\" data-end=\"3600\">Cour de cassation, chambre sociale, 13 septembre 2023, n\u00b0 21-11.432<\/p>\n<\/li>\n<\/ul>\n<div>Besoin de s\u00e9curiser vos pratiques RH ?
