This practice was contrary to European Union law. <\/p>\n<h2>Court of Cassation decisions<\/h2>\n<p>The Cour de cassation has issued the following two decisions:<\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d6f038f elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d6f038f\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-bef3114\" data-id=\"bef3114\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-c71592d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c71592d\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element elementor-element-1c8af4d\" data-id=\"1c8af4d\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b256212 elementor-widget elementor-widget-text-editor\" data-id=\"b256212\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><strong>Acquiring paid leave during non-work-related sick leave<\/strong><\/p>\n<p>The French Supreme Court has ruled that the provisions of French law do not comply with European Union law.<\/p>\n<p>In other words, employees suffering from an illness or accident of any kind, whether occupational or non-occupational, will continue to acquire paid leave entitlements for the duration of their absence from work.<\/p>\n<p><i>(Cass.soc. September 13, 2023, no. 22-17.340)<\/i><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element elementor-element-5aef8a4\" data-id=\"5aef8a4\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e557b4a elementor-widget elementor-widget-text-editor\" data-id=\"e557b4a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><strong>Acquiring paid leave after a workplace accident<\/strong><\/p>\n<p>Contrary to previous French law, the French Supreme Court has ruled that in the event of an accident at work or occupational disease, vacation pay cannot be limited to one year.<\/p>\n<p>From now on, paid leave will be earned for the entire duration of the work stoppage, and will no longer be limited to a single year.<\/p>\n<p><i>(Cass. Soc. September 13, 2023, no. 22-17.638)<\/i><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2036381 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2036381\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-fc806b2\" data-id=\"fc806b2\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-6a8eb71 elementor-widget elementor-widget-text-editor\" data-id=\"6a8eb71\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><strong>Things to remember :<\/strong><\/p>\n<ul>\n<li>Paid leave must now be calculated taking sick leave into account.<\/li>\n<li>This decision applies to the 5 statutory weeks of paid leave, as well as to conventional vacations.<\/li>\n<li>For earlier periods, companies are advised to check whether adjustments are necessary for the last three years, as vacation pay is in the nature of wages and is subject to a three-year statute of limitations.
