However, <strong>payment for overtime <\/strong>worked must be <strong>increased<\/strong>. <\/p>\n<h2><strong>Overtime bonuses<\/strong><\/h2>\n<p>The <strong>rate of overtime pay<\/strong> is defined by the company&#8217;s <strong>collective bargaining agreement<\/strong>. It must be at <strong>least 10%.<\/strong> <\/p>\n<p><strong>In excess of 220 hours&#8217; overtime per year<\/strong>, the employee is entitled to time off in lieu. However, the company may stipulate a different ceiling in its collective bargaining agreement. <\/p>\n<p>If the company&#8217;s collective bargaining agreement does not stipulate the conditions for increasing overtime pay, overtime must be increased in accordance with article L. 3121-36 of the French Labor Code:<\/p>\n<ul>\n<li><strong>25%<\/strong> for the first 8 hours ;<\/li>\n<li><strong>50%<\/strong> for overtime in excess of 8 hours.<\/li>\n<\/ul>\n<h2><strong>Alternatives to overtime pay<\/strong><\/h2>\n<p>A company&#8217;s collective bargaining agreement may provide for alternatives to overtime pay.<\/p>\n<p>It can be :<\/p>\n<ul>\n<li><strong>Compensatory rest<\/strong> in lieu of overtime pay;<\/li>\n<li>A <strong><a href=\"https:\/\/www.avocat-desrumaux.fr\/forfait-jours-tout-savoir-sur-la-convention-de-forfait-jour\/\">fixed-rate agreement<\/strong>:<\/a> This is particularly the case for managers who regularly work more than 35 hours a week, so overtime is included in their fixed-rate agreement.<\/li>\n<\/ul>\n<p>Furthermore, the employer is not obliged to <a href=\"https:\/\/www.avocat-desrumaux.fr\/ne-pas-payer-des-heures-supplementaires-a-son-salarie-est-ce-si-grave\/\">pay overtime worked by the employee<\/a> if the latter has done so of his <strong>own accord<\/strong>. In this case, the employer will have to prove that <strong>the overtime worked by the employee was not at the employee&#8217;s request,<\/strong> and was simply at the employee&#8217;s will. <\/p>\n<h2><strong>What are the employer&#8217;s obligations?<\/strong><\/h2>\n<p>Employers are obliged to <a href=\"https:\/\/www.avocat-desrumaux.fr\/les-mentions-obligatoires-du-bulletin-de-paie\/\">mention overtime worked by their employees on their<\/a> pay slips. Failure to do so may result in prosecution for the <strong>offence of <\/strong><a href=\"https:\/\/www.avocat-desrumaux.fr\/en\/automatic-compensation-for-employees-who-exceed-maximum-working-hours\/\">concealed work, and the payment of compensation to the employee<\/a> equal to 6 months&#8217; salary. <\/p>\n<p>The employer must be able to <strong>justify all overtime hours worked by the employee<\/strong>.<\/p>\n<h2><strong>What recourse does an employee have for unpaid overtime?<\/strong><\/h2>\n<p>An employee who has not been compensated for overtime, despite an attempt to reach an amicable agreement with his employer, may take his case to the <strong>Conseil de Prud&#8217;<\/strong> hommes <strong>within 3 years<\/strong>. The employee may request <strong>payment of<\/strong> unpaid <strong>overtime<\/strong> and claim <strong>damages<\/strong> from the employer. <\/p>\n<p>Despite the <strong>employer&#8217;s serious failure<\/strong> to pay overtime, the employee may decide to terminate his or her employment contract with the company.<\/p>\n<p>He can ask the judge to <strong>dismiss<\/strong> him <strong>without real and serious cause<\/strong> by <strong>taking action to <\/strong><a href=\"https:\/\/www.avocat-desrumaux.fr\/en\/automatic-termination-of-a-fixed-term-employment-contract\/\">terminate his employment contract<\/a>, or to <strong>terminate<\/strong> his employment contract <strong>by court order<\/strong>, which will have the same effect as a dismissal without real and serious cause.<\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>An employee may be required to work more than the weekly hours stipulated in his employment contract, at his employer&#8217;s request.
